<br /> 1'7,2014,Contract,Nb.C 1314-047("the'Agreement"), between the City and Consultant attached hereto-as
<br /> Attachment whose Federal Identification.II is 65-0454070. The City and Consultant:herebyagree=as.
<br /> follows:.
<br /> 1. ADDITIONAL SCOPE. Section 2 of the original Agreement is hereby amended to include
<br /> additional engineering, environmental permitting, and MEP services for improvements at Samson .
<br /> Oceanfront Park, ("Additional Services"), as set forth in the Consultant's proposal, a copy of'which•is
<br /> attachedhereto-and'incorporated Herein asAttachment"A".
<br /> 2. ADDITIONAL.COMPENSATION. The.contract amount of'Four Hundred Eighty Eight
<br /> Thousand Eight'Hundred TwentyFive Dollars and .Fifty Cents:($488,825.50), approved by the City
<br /> Commission via Resolution No.. 20'16-2623, on November 17,-2016, :is hereby amended 'to 'include
<br /> Additional Compensation for the Additional Services in an amount.notto exceed Forty Nine Thousand
<br /> Nine Hundred Dollars($49,900:00), bringing the.total contract amount not to exceed Five.Hundi•ed Thirty
<br /> Eight Thousand.Seven Hundred'Twenty Five Dollarsand=Fifty Cents($538,725.50).
<br /> 3. OTHER PROVISIONS REMAIN.IN EFFECT. Except as specifically modified herein,:all
<br /> teiMS and conditions of the'original Agreement between the.parties dated April 17, 2014,'shall remain in
<br /> full force and effect.
<br /> 4. CONFLICTING PROVISIONS. The terms, statements, requirements, or provisions contained
<br /> in this Fifth Amendment shall prevail and be given superior effect and priority over'any conflicting or t
<br /> inconsistent-terms,statements,.requirements or provisions contained in any other document Oi attachment„ I
<br /> including but not limited to Attachments"A"and"B".
