O�SoNNY/S`E�O 16: AGREEMENT BETWEEN THE L CITY OF SUNNY ISLES BEACH AND SE ,'F L O V SE' BETTOLI TRADING CORPORATION D/B/A BETTOLI VENDING CONTRACT NO. C1617-070 THIS AGREEMAIIVI NT (hereinafter referred to as the "Agreement") is made in duplicate, this zjo day of , 2017, by and between the CITY OF SUNNY ISLES BEACH, Florida, (hereinafter referred to as "City"), and BETTOLI TRADING CORPORATION D/B/A BETTOLI VENDING a corporation authorized to do business in the State of Florida (hereinafter referred to as "Contractor") whose Federal I.D. # is 66-1057065. RECITALS WHEREAS, the City is in need of a vending machine company to provide City wide healthy organic vending machine services at various locations including City Hall, Pelican Community Park, Samson Ocean Front Park, Heritage Park, and Town Center Park ("Services"); and WHEREAS, the City issued Request for Proposal No. 17-03-01 for Organic Vending Machines and the Contractor submitted a response thereto; and WHEREAS, Contractor is a certified and insured company with the necessary experience to provide the desired Services; and WHEREAS, the City wishes to contract with Contractor to provide the desired Services with the City wherein the City shall receive commission on sales which is determined based on the vending price to the public, as more particularly described in Attachment "A". NOW THEREFORE, in consideration of the promises and the mutual covenants herein name, the parties agree as follows: 1. RECITALS. The Recitals set forth above are hereby incorporated into this agreement and made a part hereof for reference. 2. SERVICES. Contractor shall provide to the City the Services as more particularly described in Attachment""A" attached hereto and made a part hereof. All vending machines shall be designed, constructed, installed, and operated in accordance with local, slate, and national codes and regulations as applicable, including, but not limited to any FDA caloric disclosure requirements. The City desires to achieve one hundred percent (100%) healthy vending in all of its parks and facilities. However, understanding the public desires options, it shall be required that at least fifty percent (50%) of snacks and beverages offered for sale at any City Facility meet the USDA and Fit Pick nutritional requirements, including food and calorie labeling. The City shall have the right to request student accessed vending machines to meet or exceed the recommendations in with the School Board of Miami-Dade County Wellness Policy.
