RESOLUTION NO. 2017-4411 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, RATIFYING A TEMPORARY <br /> EASEMENT AGREEMENT BETWEEN THE CITY OF SUNNY ISLES <br /> BEACH AND MIAMI-DADE COUNTY REGARDING THE USE OF <br /> BELLA VISTA PARK FOR BEACH RENOURISHMENT PURPOSES, <br /> ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY <br /> ATTORNEY AND THE CITY MANAGER TO DO ALL THINGS <br /> NECESSARY TO EFFECTUATE THE TERMS OF THIS <br /> RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the City of Sunny Isles Beach ("City"), Miami-Dade County ("County"), the <br /> Florida Department of Environmental Protection ("FDEP") and the United States Army Corps of <br /> Engineers ("Corps") have jointly coordinated efforts to conduct beach restoration on eroded beach <br /> areas of the City; and <br /> WHEREAS, the County, on behalf of the Corps, requires a staging area in the area of Bella <br /> Vista Park in order to stage the vehicles and equipment needed to install the fill along the beach; and <br /> WHEREAS, the City and County agree to enter into a Temporary Easement Agreement in <br /> order to accomplish this objective; and <br /> WHEREAS, the City Commission wishes to ratify the Temporary Easement Agreement. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Ratifying the Temporary Easement Agreement. The Temporary Easement Agreement <br /> for the area commonly known as `Bella Vista Park" to be used for beach renourishment purposes and <br /> attached hereto as Exhibit "A" is hereby ratified. <br /> Section 2. Authorization of City Manager and City Attorney. The City Manager and City Attorney <br /> --are authorized to do all things necessary to effectuate the terms of this Resolution. <br /> Section 3.
