RESOLUTION NO. 2017 - Z40960 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, REQUESTING WAIVER OF <br /> THE BIDDING REQUIREMENTS SET FORTH IN CHAPTER 62 <br /> OF THE CITY CODE; AUTHORIZING THE CITY MANAGER TO <br /> NEGOTIATE AND ENTER INTO AN AGREEMENT WITH ROHL <br /> NETWORKS, LP FOR MODIFICATIONS TO THE GATEWAY <br /> PARK PROJECT, IN AN AMOUNT NOT TO EXCEED ONE <br /> HUNDRED FIFTY THOUSAND DOLLARS ($150,000.00), <br /> PROVIDED SAID AGREEMENT IS FIRST APPROVED AS TO <br /> FORM AND LEGAL SUFFICIENCY BY THE CITY ATTORNEY; <br /> AUTHORIZING THE CITY MANAGER AND THE CITY <br /> ATTORNEY TO DO ALL THINGS NECESSARY TO <br /> EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, on November 24, 2016 the City opened Gateway Park on a limited basis; <br /> and <br /> WHEREAS, staff has determined that there are operational safety issues that must be <br /> addressed prior to full park opening; and <br /> WHEREAS, the City is in need of a contractor to address the remaining issues and has <br /> determined that Rohl Networks, LP is qualified, willing, and able to perform the services as <br /> specified by the City; and <br /> WHEREAS, due to the operational safety concerns the City Manager is recommending <br /> the City Commission waive the bidding requirements set forth in Chapter 62 of the City Code as <br /> it is in the best interests of the City to do so; and <br /> WHEREAS, the City Commission wishes to waive the bidding requirements of Chapter <br /> 62 of the City Code and authorize the City Manager to negotiate and enter into an Agreement <br /> with Rohl Networks, LP for Modifications to the Gateway Park Project in an amount not to <br /> exceed One Hundred Fifty Thousand Dollars ($150,000.00), provided said Agreement is first <br /> approved as to form and legal sufficiency by the City Attorney. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Waiver of Bidding Requirements. The City Commission hereby waives the <br /> bidding requirements set forth in Chapter 62 of the City Code. <br /> Section 2. Authorization of City Manager.
