impending call or order to covered active duty. [See Family and Medical <br /> Leave (FMLA), policy 704:21. <br /> g. Military Leave of Absence: A military leave of absence will be granted if an <br /> employee is absent in order to serve in the uniformed services of the United <br /> States for a period of up to five years (not including certain involuntary <br /> extensions of service) pursuant with the requirements of the Uniformed <br /> Services Employment and Reemployment Rights Act of 1994 (USERRA) <br /> and Florida laws under Title X, Ch. 115 regarding military leave. An <br /> employee is eligible for military leave beginning the first day of employment. <br /> Employees who perform and return from service in the Armed Forces, the <br /> Military Reserves, the National Guard, or certain Public Health Service <br /> positions will retain certain rights with respect to reinstatement, seniority, <br /> layoff, compensation, length of service promotions, and length of service <br /> pay increases, as required by applicable federal or state law. [See Military <br /> Leave, policy 703:3]. <br /> During participation in annual encampment or training duty in the U.S. <br /> Military Reserves or the National Guard, the employee may be eligible to <br /> straight time pay with eligible benefits for the first thirty (30) days of <br /> arns from the government for military service and what the employee <br /> would have earned from normal straight time pay on the job (provided it is <br /> more) with paid eligible benefits for up to one (1) year. Continuation of pay <br /> state or national emergency will be handled on a case by case basis and <br /> h. Leaves of absence approvals are subject to the operational needs of the <br /> Department. <br /> 3. Requests for a leave of absence or any extension of a leave ordinarily should be <br /> submitted in writing to the employee's department head at least thirty (30) days <br /> before the start of the leave or extension period. When the need for leave or an <br /> extension is not foreseeable, employees should give as much notice as is possible. <br /> The department head will forward the request through the Human Resources <br /> Director, recommending approval or denial. The final decision concerning the <br /> request will be made by the City Manager.
