City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br /> (305) 947-0606 phone (305) 949-3113 Fax <br /> reports thereto during the period of the Force Majeure; <br /> (b) Contractor shall also be excused for any delays in the performance of its <br /> obligations under this Agreement to the extent said delays were caused by the City <br /> and/or any other governmental entity; <br /> (c) the excise of performance is of no greater scope and of no longer duration than is <br /> required by Force Majeure; <br /> (d) no obligations of either party that arose before the Force Majeure causing the <br /> excuse of performance are expected as a result of the Force Majeure; and <br /> (e) the non-performance party uses its best efforts to remedy its inability to perform. <br /> 11. INSURANCE. Contractor shall, at its sole cost and expense, during the period of any <br /> work being performed under this Agreement, procure and maintain the following minimum <br /> insurance coverage to protect the City and Contractor against all loss, claims, damage and <br /> liabilities caused by Contractor, its agents or employees, as indicated below: <br /> ❑ Comprehensive General liability insurance, including broad form contractual <br /> liability coverage for all operations, including, but not limited to, contractual, <br /> products, and completed operations, personal injury and property damage liability <br /> with minimum limits of One Million Dollars ($1,000,000) per occurrence <br /> combined single limit for Bodily Injury Liability and Property Damage Liability. <br /> Coverage must be offered in a form no more restrictive than the latest edition of the <br /> Comprehensive General Liability policy, without restrictive endorsements, as filed <br /> by the Insurance Services Office, and shall specifically include the following with <br /> minimum limits not less than those required for Bodily Injury Liability and <br /> Property Damage Liability: <br /> o Premises and Operation; <br /> o Independent Contractors; <br /> o Products and/or Completed Operations Hazard; <br /> o Broad Form Property Damage; <br /> o Broad Form Contractual Coverage applicable to this specific Contract, <br /> including any hold harmless and/or indemnification agreement. <br /> o Personal Injury Coverage with Employee and Contractual Exclusions <br /> removed, with minimum limits of coverage equal to those required for <br /> Bodily Injury Liability and Property Damage Liability. <br /> ❑ Worker's Compensation and employer's liability coverage, as required pursuant to <br /> Florida law. <br /> 6 SB <br /> C6523-1617-073-SUMMA MECHANICAL CONTRACTORS LLC D/B/A SMC AIR CONDITIONING <br />
