NOW,THEREFORE,BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance.These clauses represent the legislative findings of the City Commission. It is the purpose and intent of this Ordinance to promote the health, safety, and welfare of the residents and visitors of the City of Sunny Isles Beach. Section 2. Definition. For purposes of this Ordinance a"Medical Marijuana Treatment Center" or"Medical Marijuana Dispensing Facility"shall be defined as a business and/or a location or place permitted by State law to acquire, cultivate, possess, process, transfer, transport, sell, distribute, dispense, prescribe or otherwise administer legal marijuana/cannabis. Section 3. Prohibition against any Medical Marijuana Treatment Center or Medical Marijuana Dispensing Facility within the City of Sunny Isles Beach. The City Commission hereby prohibits any Medical Marijuana Treatment Center or Medical Marijuana Dispensing Facility from being located anywhere within the corporate boundaries of the City of Sunny Isles Beach. Section 4. Inclusion in the Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word, as required. Section 5. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 6. Repealer. All Ordinances or part of Ordinances in conflict herewith be and the same are hereby repealed Section 7. Effective Date.
