Parker, Building Official/Floodplain Manager <br /> DATE: 9/21/2017 <br /> RE: Adoption of a New Floodplain Management Ordinance <br /> RECOMMENDATION: <br /> Staff recommends the City Commission adopts this ordinance to <br /> repeal in its entirety Chapter 161 and adopts a new Chapter 161. <br /> REASONS: <br /> The City of Sunny Isles Beach is required as a condition of continued <br /> eligibility in the National Flood Insurance Program (NFIP) to adopt or <br /> show evidence of adoption of floodplain management regulations that <br /> meet the standards of Paragraph 60.3 (e) of the NFIP regulations. In <br /> addition, by law, the Florida Building Code (FBC) contains all laws and <br /> rules that pertain to and govern the design and construction of buildings <br /> (Section 553.73(1)(a), F.S.). This means that the flood provision of the <br /> FBC that govem the flood resistant design of buildings in mapped <br /> flood zones, Special Flood Hazard Areas, (SFHA) supersede local <br /> regulations that are not consistent with the FBC. Thus, to avoid <br /> inconsistencies and possible conflicts, it is important to adopt this <br /> model ordinance which is specifically designed to repeal and replace <br /> existing regulations to satisfy the NFI P, to coordinate with the FBC, and <br /> to meet the requirements of section 553.73(5), F.S <br /> ATTACHMENTS: <br /> Description <br /> Ordinance <br /> 30 <br />
