PERKINS +WILL City of Sunny Isles Beach 18070 Collins Avenue,Sunny Isles Beach,Florida 33160 (305)947-0606 phone(305)949-3113 Fax The Architect agrees,to the fullest extent permitted by law,to indemnify and hold harmless the Owner,its representatives,officers,directors,officials and employees from and against claims, damages, losses and expenses (including but not limited to reasonable attorney's fees and costs)to the extent the same are caused by the Architect's negligent acts,errors, mistakes or omissions relating to professional services in the performance of this Agreement. The Architect and Owner waive consequential damages for claims, disputes or other matters in question arising out of or relating to this Agreement. This mutual waiver is applicable, without limitation, to all consequential damages due to either party's termination of this Agreement,except as specifically provided in Article 11. 16.8 Insurance Requirements: The Architect shall maintain during the terms, except as noted, of this Agreement the following insurance: A. Professional Liability Insurance in the amount of One Million Dollars ($1,000,000.00 per claim and aggregate), which shall be the limit of liability providing for all sums which the Architect shall become legally obligated to pay as damages for claims to the extent caused by negligent acts, errors, or omissions pertaining to professional services performed by the Architect. This insurance shall be maintained for three years after completion of the construction and acceptance of any Work covered by this Agreement. B. Commercial general liability insurance with broad form endorsement, including completed operations and products liability, contractual liability, severability of interests with cross liability provision, and personal injury and property damage liability per the CG 00 01 or equivalent with limits of One Million Dollars ($1,000,000.00) combined single limit per occurrence, Two Million Dollars ($2,000,000.00) general aggregate, and Two Million Dollars ($2,000,000.00) products/completed operations aggregate. Said policy or policies shall name Owner as additional insured. I t C. Workman's Compensation Insurance for the employees of Architect as required by Florida Statutes,Section 440,and employers'liability insurance with limits not less111 than One Million Dollars ($1,000,000.00) each accident/disease-policy limit/disease-per employee. D.
