<br />City of Sunny Isles Beach |Request for Qualifications No. 18-02-01 12 <br /> <br />Supplemental Federal Provisions, the Supplemental Federal Provisions shall prevail. Proposer <br />agrees to comply, subject to applicable professional standards, with the provisions of any and all <br />applicable Federal, State, County and City orders, statutes, ordinances, rules and regulations which <br />may pertain to the Services required under the Agreement, including but not limited to: <br /> <br />A. Occupational Safety and Health Act (OSHA), as applicable to this contract. <br /> <br />B. Federal Highway Administration (FHWA), Environmental Protection Agency (EPA), Florida <br />Department of Transportation (FDOT), American Disability Act (ADA), Florida Department of <br />Environmental Protection (FDEP), as applicable to this contract. <br /> <br />C. 41 CFR 60-1.4 - Equal opportunity clause. The contractor will not discriminate against any <br />employee or applicant for employment because of race, color, religion, sex, sexual orientation, <br />gender identity, or national origin. The contractor will take affirmative action to ensure that <br />applicants are employed, and that employees are treated during employment, without regard to <br />their race, color, religion, sex, sexual orientation, gender identity, or national origin. Such action <br />shall include, but not be limited to the following: Employment, upgrading, demotion, or transfer, <br />recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of <br />compensation; and selection for training, including apprenticeship. The contractor agrees to post <br />in conspicuous places, available to employees and applicants for employment, notices to be <br />provided by the contracting officer setting forth the provisions of this nondiscrimination clause. <br /> <br />D. "Conflicts of Interest" 23 CFR 1.33 <br /> <br />E. 2 C.F.R. § 200.317 through 2 C.F.R. Part 200.326, as applicable to contract. <br /> <br />F. Compliance with Regulations: The Contractor shall comply with the Regulations relative to <br />nondiscrimination in Federally-assisted programs of the U.S. Department of Transportation <br />(hereinafter, “USDOT”) Title 49, Code of Federal Regulations, Part 21, as they may be amended <br />from time to time, (hereinafter referred to as the Regulations), which are herein incorporated by <br />reference and made a part of this Agreement. <br /> <br />2.12 LICENSES FOR TRADES <br /> <br />Contractor(s) must be licensed in accordance with the provisions of the Code of Miami-Dade <br />County and Florida State Statute. The Contractor may be required to provide proof of licensing <br />prior to being awarded under this Contract. All employees supplied by the Contractor must carry <br />their certification cards, if certification is required for the type of Work being performed. <br /> <br />2.13 Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclus ion <br /> – First Tier Participants: <br /> <br />a.
