<br />City of Sunny Isles Beach |Request for Proposals No. 18-03-01 14 <br /> <br /> <br />Information Center/National Crime Information Center (“FCIC/NCIC”) criminal records <br />check. Any employee not meeting this requirement will not be permitted to work at any <br />City facility. <br /> <br />2.13 FEDERAL AND STATE REGULATIONS <br /> <br />The Contractor shall comply with all applicable federal, state and local rules and <br />regulations regarding the provision of Services. City and Contractor agree to comply with <br />and observe all applicable laws, codes and ordinances as that may in any way affect the <br />goods or service offered, including but not limited to: <br /> <br />A. Executive Order 11246, which prohibits discrimination against any employee, applicant, <br />or client because of race, creed, color, national origin, sex, or age with regard to, but not <br />limited to, the following: employment practices, rate of pay or other compensation <br />methods, and training selection. <br />B. Occupational, Safety and Health Act (OSHA), as applicable to this Formal Solicitation. <br />C. The State of Florida Statutes, Section 287.133(3)(A) on Public Entity Crimes. <br />D. Uniform Commercial Code (Florida Statutes, Chapter 672). <br />E. Americans with Disabilities Act of 1990, as amended. <br /> <br />2.14 TERMINATION FOR CONVENIENCE <br /> <br />This agreement may be terminated immediately by the City without cause upon written <br />notice to the Contractor. In the event of such a termination without cause, the Contractor <br />shall be compensated for all services performed to the City’s satisfaction and prior to <br />termination. <br /> <br />2.15 EVENT OF DEFAULT <br /> <br />An Event of Default shall mean a breach of the Agreement by the Contractor. Without <br />limiting the generality of the foregoing and in addition to those instances referred to herein <br />as a breach, an Event of Default, shall include the following: <br /> <br />1. The Contractor has not delivered Deliverables on a timely basis; <br />2. The Contractor has refused or failed, except in any case for which an extension of <br />time is provided, to supply enough properly skilled staff personnel;
