<br />City of Sunny Isles Beach |Request for Proposals No. 18-03-01 16 <br /> <br /> <br />2.19 NON-EXCLUSIVE CONTRACT <br /> <br />Proposer agrees and understands that the contract shall not be construed as an exclusive <br />arrangement and further agrees that the City may, at any time, secure similar or identical <br />services from another vendor at the City’s sole option. <br /> <br />2.20 EXCEPTIONS TO PROPOSAL <br /> <br />The bidder must clearly indicate any exceptions they wish to take to any of the terms in <br />this Proposal, and outline what, if any, alternative is being offered. All exceptions and <br />alternatives shall be included and clearly delineated, in writing, in the Proposal. The City, <br />at its sole and absolute discretion, may accept or reject any or all exceptions and <br />alternatives. In cases in which exceptions and alternatives are rejected, the City shall <br />require the Bidder to comply with the particular term and/or condition of the solicitation <br />to which the Bidder took exception to (as said term and/or condition was originally set <br />forth on the solicitation.) <br />2.21 EMERGENCY/DISASTER PERFORMANCE <br /> <br />In the event of a hurricane or other emergency or disaster situation, the successful <br />vendor may provide the City with the commodities/services defined within the scope of <br />this formal solicitation at the price contained within vendor's response. Further, <br />successful vendor shall deliver/perform for the city on a priority basis during such times <br />of emergency. <br /> <br />2.22 DAMAGE TO PUBLIC OR PRIVATE PROPERTY <br /> <br />Extreme care shall be taken to safeguard all existing facilities, site amenities, irrigation <br />systems, vehicles, etc. on or around the job site. Damage to public and/or private property <br />shall be the responsibility of the Contractor and shall be repaired and/or replaced at no <br />additional cost to the City. <br /> <br />2.23 PUBLIC RECORDS <br /> <br />IF THE SUCCESSFUL PROPOSER HAS QUESTIONS REGARDING <br />THE APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO <br />THE SUCCESSFUL PROPOSER’S DUTY TO PROVIDE PUBLIC <br />RECORDS RELATING TO THIS AGREEMENT, CONTACT THE <br />CUSTODIAN OF PUBLIC RECORDS AT CITY OF 18070 COLLINS <br />AVENUE, SUNNY ISLES BEACH, FL 33160. THE CITY CLERK’S
