• <br /> • <br /> City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br /> (305) 947-0606 phone (305)949-3113 Fax <br /> 4.12 Additional services in connection with the Projects not otherwise provided for in this <br /> Agreement. <br /> ARTICLE 5 <br /> TIME <br /> 5.1 The Architect shall perform Basic and Additional Services as expeditiously as is consistent <br /> with professional skill and care and the orderly progress of the Projects. The Feasibility <br /> Study/Program Verification,schematic design documents, specifications, and construction <br /> documents shall be completed in a time frame as detailed in Architect's response to Request <br /> for Qualifications ("RFQ")No. 17-12-01, as set forth in Attachment "A" and Attachment <br /> «B„ <br /> 5.2 The Architect shall not be liable for failure to perform the contract or meet any schedule of <br /> performance of services to the extent that any delay or impediment arises from causes <br /> beyond the control and without the fault or negligence of the Architect. Examples of such <br /> • <br /> causes include acts of God or of the public enemy, acts of the Owner or third parties, fires, <br /> floods, pandemics or epidemics, quarantinerestrictions, strikes or labor actions, boycotts, <br /> freight embargoes, and unusually severe weather. If the failure to perform is caused by the <br /> default of one or more of Architect's sub-consultants at any tier, and if the cause of the <br /> default is beyond the control of both the Architect and such sub-consultant,and without the <br /> fault or negligence of either,the Architect shall not be liable for any excess costs for failure <br /> to perform and shall be entitled to an equitable adjustment of Architect's fee. <br /> 5.3 The Architect agrees to start the Projects upon receipt of a Notice to Proceed(NTP) issued <br /> by the Owner or their designee and to complete each assignment, task or phase within the <br /> time stipulated in the NTP. A reasonable extension of timefor completion of various <br /> assignments, tasks or phases may be granted by the City shouldthere be a delay on the part <br /> of the City in fulfilling its obligations under this Agreement as stated herein. Such extension <br /> of time shall not be cause of any claim by Architect for additional compensation. <br /> ARTICLE 6 <br /> THE OWNER'S RESPONSIBILITIES <br /> 6.1 The Owner shall provide full information as to his requirements for the Projects. <br /> 6.2 The Owner shall designate a representative authorized to act on his behalf.
