<br />City of Sunny Isles Beach | ITB 18-03-03 Right-of-Ways and Facilities Landscape Maintenance Services 12 <br /> <br />Notice of Award, the Agreement <br />between the City and Contractor as <br />well as any addenda thereto, these <br />General Conditions, Special <br />Conditions, the Technical <br />Specifications, Drawings and <br />Modifications, Notice to Proceed, <br />Invitation to Bid, Insurance <br />Certificates, Change Orders and <br />Acknowledgment of Conformance <br />with the City of Sunny Isles Beach. <br /> <br />Contract Price: The total monies payable to the <br />Contractor under the Contract <br />Documents. <br /> <br />Contract Time: The number of calendar days <br />stated in the Agreement for the <br />completion of the Work. <br /> <br />Contracting Officer: The individual who is authorized to <br />sign the contract documents on <br />behalf of the City’s governing body. <br /> <br />Contractor: The person, firm or corporation <br />with whom the City has executed <br />this Agreement. <br /> <br />Day: A calendar day of twenty-four <br />hours measured from midnight to <br />the next midnight. <br /> <br />Designee: A person(s) selected by the City <br />Manager to carry out a duty or role. <br /> <br />Field Order: A written order issued by the City <br />which clarifies or interprets the <br />Contract Documents or orders <br />minor changes in the Work. <br /> <br />Modification: Modification means any one of the <br />following: (a) a written <br />amendment of the Contract <br />Documents signed by both parties, <br />(b) a Change Order, (c) a written <br />clarification or interpretation if <br />issued by the City, or (d) a written <br />order for minor change or <br />alteration in the Work issued by the <br />City. A modification may only be <br />issued after execution of the <br />Agreement. <br /> <br />Non-Compliant <br />Work: Work performed by the Contractor <br />that has been determined through <br />City inspection to not meet the <br />Performance Standards. <br /> <br />Notice of Award: The written notice by City to the <br />apparent successful Bidders stating <br />that upon compliance with the <br />conditions precedent to be fulfilled <br />by him within the time specified, <br />City will execute and deliver the <br />Agreement to him. <br /> <br />Notice to Proceed: The written letter or directive <br />issued by the City Manager or <br />designee acknowledging that all <br />conditions precedent to award <br />have been met and directing that <br />the Contractor may begin Work. <br /> <br />Performance <br />Standards: The desired results established for <br />each type of Work described in the <br />ITB, necessary to be deemed <br />Satisfactory. <br /> <br />Project: A task or series of tasks that the <br />Contractor must complete in <br />accordance with the Contract <br />Documents. <br /> <br />Project Manager: The individual(s) assigned by the <br />City Manager or designee to <br />manage the project. <br /> <br /> <br />Quality Assurance: Those actions taken by the City to <br />assure Services meet the <br />Satisfactory Performance <br />Standards established by the <br />Contract Documents. <br /> <br />Quality Control: Those actions taken by the <br />Contractor to ensure the <br />Contractor’s performance meets <br />the Performance Standards. <br /> <br />Re-Work: Corrective Work performed by the <br />Contractor, at no cost to the City, <br />to meet the Performance <br />Standards. <br /> <br />Responsive Bidder: The Bidder whose Bid conforms in <br />all material respects to the terms <br />and conditions included in the ITB. <br /> <br />Responsible Bidder: The Bidder who has the capability <br />in all respects to perform in full the <br />contract requirements, as stated in <br />the ITB, and the integrity and <br />reliability that will assure good faith <br />performance. <br /> <br />Samples: Physical examples which illustrate <br />materials, equipment or <br />workmanship and establish <br />standards by which the Work will <br />be judged. <br /> <br />Satisfactory: Work performed by the Contractor <br />that has been determined through <br />City inspection to meet the <br />Performance Standards. <br /> <br />Site(s): The location(s) where Work is to be <br />performed under this Contract. <br />
