<br />City of Sunny Isles Beach | ITB 18-03-03 Right-of-Ways and Facilities Landscape Maintenance Services 31 <br /> <br /> <br />The Contractor must take all necessary precautions for the safety of employees in the performance <br />of the Work on, about or adjacent to the premises, and must comply with all applicable provisions <br />of Federal, State, and local laws, including, but not limited to the requirements of the Occupational <br />Safety and Health Act of 1970 (OSHA), and amendments thereto, to prevent accidents or injury to <br />persons on, about or adjacent to the premises where the Work is being performed. Contractor <br />must notify owners of adjacent property and utilities when execution of the Work may affect th em. <br /> <br />The Contractor must comply with the OSHA “Federal Right to Know” Regulation, 29 CFR 1910, <br />1915, 1917, 1918, and 1926, regarding informing employees of toxic substances in the workplace, <br />providing training, and emergency procedures. <br /> <br />Contractor must adhere to applicable environmental protection guidelines for the duration of the <br />Work. The Contractor must comply with all codes, ordinances, rules, orders and other legal <br />requirements of public authorities (including OSHA, EPA, DERM, the City, Miami -Dade County, State <br />of Florida), which bear on the performance of the Work. <br /> <br />The Contractor must provide such equipment and facilities as are necessary or required, in the <br />case of accidents, for first aid service to person who may be injured during the Project(s) duration. <br /> <br />Barricades shall be provided by the bidder when work is performed in areas traversed by persons, <br />or when deemed necessary by the City Project Manager(s). <br /> <br />Contractor’s duties and responsibilities for the safety and protection of the Work must continue <br />until such time as all the completion of the Contract. <br /> <br />2.29 MATERIAL SAFETY DATA SHEETS <br /> <br /> In compliance with Chapter 442, Florida Statutes, any toxic substance listed in Section 38F -41.03 <br />of the Florida Administrative Code delivered as a part of the Project must be accompanied by a <br />Material Safety Data Sheet (MSDS) which must be obtained from the manufacturer. The MSDS <br />must include the following information: <br /> The chemical and the common name of the substance. <br /> The hazards or other risks in the use of the substance, including: <br />o The potential for fire, explosion, corrosion, and reaction; <br />o The known acute and chronic health effects of risks from exposure, including the <br />medical conditions which are generally recognized as being aggravated by <br />exposure to the substance; and <br />o The primary routes of entry and symptoms of overexposure. <br /> The proper precautions, handling practices, necessary personal protective equipment, and <br />other safety precautions in the use of or exposure to the substances, including appropriate <br />emergency treatment in the case of overexposure. <br /> The emergency procedures for spills, fire, disposal, and first aid. <br /> A description in lay terms of the known specific potential health risks posed by the <br />substance intended to alert any person reading information.
