<br /> continuation of the contract beyond the initial period, and any option subsequently exercised shall
<br /> be at the sole discretion of the City, and not a right of the Bidder. Renewals shall be exercised
<br /> only when such continuation is clearly in the best interest of the City.
<br /> Should the Bidder decline the City's right to exercise the option period, the City may consider the
<br /> Bidder in default, which may affect the Bidder's eligibility for future contracts.
<br /> NOTE: IF MULTIPLE BIDDERS ARE INVOLVED UNDER THE GIVEN CONTRACT, ANY
<br /> OPTIONS TO RENEW WILL BE RESTRICTED TO THE SPECIFIC ITEMS OF WORK
<br /> INITIALLY AWARDED TO ANY SPECIFIC BIDDER.
<br /> 2.5 METHOD OF AWARD
<br /> Following the review of proposals, the lowest responsible, responsive bidder(s) meeting all terms,
<br /> conditions, and specifications of the ITB shall be recommended for award either by bid item, bid
<br /> group, or for the entirety of all bid items, as deemed in the best interest of the City. The City
<br /> Manager may also reject all proposals received. In determining the lowest responsible, responsive
<br /> bidder, and in addition to price, section 62-8 of the City Code provides that the City may consider
<br /> the following:
<br /> • The ability, capacity and skill of the bidder to perform the Contract.
<br /> • Whether the bidder can perform the Contract within the time specified, without delay or
<br /> interference.
<br /> • The character, integrity, reputation, judgment, experience and efficiency of the bidder.
<br /> • The quality of performance of previous contracts.
<br /> • The previous and existing compliance by the bidder with laws and ordinances relating to
<br /> the Contract.
<br /> No contract will be awarded to, any person who is in arrears to the City of Sunny Isles Beach, upon
<br /> any debt or contract, or who has defaulted, as surety or otherwise, upon any obligation to any
<br /> public agency, or who is deemed irresponsible or unreliable by the City Commission of the City of
<br /> Sunny Isles Beach, in its sole discretion.
<br /> 2.6 MULTIPLE AWARD
<br /> The City may award multiple Bidders (primary, secondary and tertiary) as available, by line item,
<br /> by group, or in its entirety. The City will endeavor to utilize Bidders in order of award. The lowest
<br /> Bidder for each group shall be considered the primary awardee and should receive the largest
<br /> volume of work, upon meeting the required qualifications and acceptance to the City's terms.
<br /> However, the City may utilize other Bidders in the event that: 1) a contract Bidder is not or is
<br /> unable to be in compliance with any contract or delivery requirement; 2) it is in the best interest
<br /> of the City to do so regardless of reason. In the event that one of the successful bidders (primary,
<br /> secondary or tertiary) are deemed to be performing unsatisfactorily as determined by the City, the
<br /> City may opt to award their designated bid group to the Bidder performing to City's approval.
