<br /> 3.5.3 Due to construction projects within the City, FDOT may require that tree pruning be
<br /> completed at night. The Contractor is responsible to perform the work in accordance with
<br /> FDOT requirements at no additional cost to the City.

<br /> 3.6 FORCE MAJEURE
<br /> If weather or other acts of nature prevents the Contractor from conducting the requested services
<br /> or maintenance on the day specified by the City or otherwise planned by the Contractor, the
<br /> Contractor shall conduct the services or maintenance requested on the following day at no
<br /> additional cost to the City (unless otherwise directed by the City). Any change in schedule due
<br /> to this section must be communicated to the Project Manager prior to the commencement of
<br /> work. This shall apply throughout this entire ITB.
<br /> 3.7 IRRIGATION SYSTEM MAINTENANCE
<br /> The Contractor must be responsible for the complete management, operation and maintenance
<br /> of all irrigation systems. Within thirty (30) days of Contract execution, the Contractor must
<br /> complete an assessment at no additional cost to the City to determine what repairs are required
<br /> at each Project Site to bring each Irrigation System to full operations. This assessment will
<br /> provide a detailed breakdown by Project Site of the repair work required and cost of repair.
<br /> Contractor will be responsible for each Irrigation system once it is fully operational.
<br /> All improved and existing areas must receive sufficient amounts of water to flower beds, turf and
<br /> landscaping, as necessary to present a uniform green color without browning or barren areas
<br /> resulting from lack of water. Any dead or under-developing plants shall be immediately replaced
<br /> by the Contractor at no cost to the City.
<br /> The Contractor,at his/her expense,will be responsible for the proper maintenance, replacement,
<br /> repair,or retro-fitting of all irrigation components. Contractor will be reimbursed for the purchase
<br /> of materials and equipment only, at actual cost to the Contractor, without mark-up, to maintain
<br /> the Irrigation System except where the repair or replacement results from damage caused by
<br /> the Contractor. Any damages resulting from accidents, vandalism, or an Act of God are
<br /> reimbursable to the Contractor on a materials basis only with proper documentation and approval
<br /> by the City. Any necessary repairs, other than routine irrigation head replacement must be
<br /> approved in writing by the City prior to start of work. Under no circumstances will the City
<br /> reimburse Contractor for mark-up on material cost.
<br /> All repairs to the system shall be identical to the original installation, unless approved otherwise
<br /> in advance by the City. If a change to the installation or material will result in lower future
<br /> maintenance costs, less frequent breakage, or an increase in public safety, the Contractor shall
<br /> request authorization, in writing, to make the change for the City. Replacement of system
<br /> components shall be the same manufacturer and model as original equipment, or better, as
<br /> authorized by City.
