(305)947-0606Cih Hall <br /> °?.° un .a° (305)949-3113 Fax <br /> MEMORANDUM <br /> TO: • The Honorable Mayor and City Commission <br /> FROM: Hans Ottinot, City Attorney <br /> DATE: 3/21/2013 <br /> RE: Third Amendment to Design Build Agreement with 4M Investors, LLC <br /> RECOMMENDATION: <br /> This Resolution is presented for your consideration. <br /> REASONS: <br /> The City of Sunny Isles Beach ("City") wishes to enter into a Third Amendment to the Design- <br /> Build Agreement with 4M Investors. LLC ("Contractor"). By way of background, the City of <br /> Sunny Isles Beach is the owner of certain real property consisting of approximately 3.7 acres on <br /> Sunny Isles Boulevard. <br /> On July 21, 2011, via Resolution No. 2011-1735, the City Commission entered into an agreement <br /> with Contractor for certain parcels of real property located in the City which the City owns and <br /> plans to construct site improvements consisting of a Park and Parking Garage for Gateway Park <br /> located in the City. <br /> Section 2.3 of the Design-Build Agreement allows the parties to amend the agreement through <br /> written amendment. Accordingly, the parties desire to enter into a Third Amendment to the <br /> Design-Build Agreement to reflect a revised scope of project and new Guaranteed Maximum <br /> Price. More precisely, the parties desire to revise the scope of the project to include (a) a 375 <br /> space parking garage building with approximately a sixteen thousand (16,000) square foot multi- <br /> purpose shell on the first floor of the building; (b) Park; (c) Performance Stage; and (d) <br /> Pedestrian Bridge. <br /> The parties also desire to revise the Guaranteed Maximum Price ("GMP") to Seventeen Million <br /> Four Hundred and Forty Thousand Dollars ($17,440,000.00) which includes design fees and <br /> costs associated with the construction of the following: (a) 375 space Parking Garage Building <br /> with the multi-purpose shell; (b) Park; and (c) Performance Stage.
