<br />City of Sunny Isles Beach |Request for Qualifications No. 18-08-01 14 <br /> <br /> Contractors must submit the certification that is attached to this agreement. Submitting a false <br /> certification shall be deemed a material breach of contract. The City shall provide notice, in writing, <br /> to the Contractor of the City’s determination concerning the false certification. The Contractor shall <br /> have ninety (90) days following receipt of the notice to respond in writing and demonstrate that <br /> the determination was in error. If the Contractor does not demonstrate that the City’s <br /> determination of false certification was made in error, then the City shall have the right to <br /> terminate the contract and seek civil remedies pursuant to Florida Statute Section 215.4725. <br /> <br />2.19 PUBLIC RECORDS <br /> <br />IF THE SUCCESSFUL PROPOSER HAS QUESTIONS REGARDING <br />THE APPLICATION OF CHAPTER 119, FLORIDA STATUTES, TO <br />THE SUCCESSFUL PROPOSER’S DUTY TO PROVIDE PUBLIC <br />RECORDS RELATING TO THIS AGREEMENT, CONTACT THE <br />CUSTODIAN OF PUBLIC RECORDS AT CITY OF SUNNY ISLES <br />BEACH 18070 COLLINS AVENUE, SUNNY ISLES BEACH, FL <br />33160. THE CITY CLERK’S OFFICE MAY BE CONTACTED BY <br />PHONE AT (305) 792-1703 OR VIA EMAIL AT <br />MBetancur@sibfl.net. <br /> <br />2.20 AUDIT RIGHT AND RETENTION OF RECORDS <br />The Consultant shall preserve and make available, at reasonable time for examination and audit <br />by the City, all financial records, supporting documents, statistical records, and any other <br />documents pertinent to this agreement for the required retention period of the Florida Public <br />Records Act (Chapter 119, Florida Statutes), if applicable, or if the Florida Public Records Act is not <br />applicable, for a minimum period of five (5) years after termination of this agreement. If any audit <br />has been initiated and audit findings have not been resolved at the end of the retention period of <br />five (5) years, whichever is longer, the books, records and accounts shall be retained until <br />resolution of the audit findings. If the Florida Public Records Act is determined by the City to be <br />applicable to contractor’s records, contractor shall comply with all requirements thereof; however, <br />no confidentiality or nondisclosure requirement of either federal or state law shall be violated by <br />contractor. Any incomplete or incorrect entry in such books, records, and accounts shall be a basis <br />for City’s disallowance and recovery of any payment upon such entry. Maintain during the term of <br />the contract all books of account, receipt invoices, reports and records in accordance with generally <br />accepted accounting practices. The consultant shall maintain and make available such records and <br />files for the duration of the contract and retain them for a period of five (5) years beyond the last <br />day of the contract term. <br />
