responsible for preparing weekly meeting minutes and distributing them to all in attendance.
<br />1 . 7 .3. It is understood and agreed that the purpose of Consultant's visits to the site is to enable
<br />Consultant to carry out the duties and responsibilities assigned to and undertaken by Consultant during the
<br />Construction Administration Phase. It is understood and agreed, as well , that another purpose of such visits
<br />and representation is that by exercise of Consultant's efforts as an experienced and qualified design
<br />professional, It will provide for a greater degree of assurance {i) that the completed work of the contractor(s)
<br />will conform to the contract documents; and (ii) that the integrity of the design concept as reflected in the
<br />contract documents has been implemented and preserved by contractor{s). Notwithstanding the foregoing
<br />purposes of visits to and representation at the construction site, however, it is further understood that
<br />Consultant will not, either during such visits or as a result of such observations of contractor(s)' work in
<br />progress, supervise, direct or have control over contractor(s)' work. Nor shall Consultant have authority over
<br />or responsibility for the means, methods, techniques , sequences or procedures of construction selected by
<br />contractor(s), for safety precautions incident to the work of contractor(s) or for any failure of contractor(s) to
<br />comply with laws, rules, regulations, ordinances, codes or orders applicable to c:ontractor{s) furnishing and
<br />performing their work. Accordingly, it is understood that Consultant can neither guarantee the performance of
<br />the construction contracts by contractor(s) nor assume responsibility for contractor(s)' failure to furnish and
<br />perform their work in accordance with the contract documents.
<br />1.7.4. During such visits and on the basis of such observations, Consultant may disapprove of or
<br />reject contractor(s)' work while it is in progress if Consultant believes that such work will not produce a
<br />completed project that conforms generally to the contract documents or that it will prejudice the integrity of the
<br />design concept or safety standards of the project as reflected in the Construction Drawings, Technical
<br />Specifications , General Conditions and Supplemental Conditions. Consultant shall have authority to stop the
<br />work whenever such stoppage may be necessary for the proper execution of the Construction Drawings,
<br />Technical Specifications, General Conditions and Supplemental Conditions or to protect the public and/or
<br />property. Consultant shall also have authority to reject all work, materials and equipment which do not
<br />conform to the Construction Drawings, Technical Specifications, General Conditions and Supplemental
<br />Conditions, and to decide questions raised by Contractor which arise in the execution of the work.
<br />1. 7 .5 . Consultant shall issue necessary interpretations and clarifications of the Construction
<br />Drawings, Technical Specifications, General Conditions, Supplemental Conditions and construction contract
<br />documents, and in connection therewith prepare work change directives and change orders as required or
<br />requested by the City. Consultant may issue additional instructions, by means of drawings, minor change
<br />orders or otherwise, necessary to Illustrate changes in the work.
<br />1. 7 .6 . Consultant will provide a response to the contractor and City with respect to a request for
<br />change order within a reasonable amount of time after receipt of contractor's notice and all necessary backup
<br />information requ ired by Consultant to formulate a response. Consultant will have authority to make minor
<br />changes in the work not involving extra cost, and not inconsistent with the purpose of the work. Consultant is
<br />not authorized to bind City to changes in contract price or time.
<br />1. 7. 7 . Consultant shall timely review and approve or take other appropriate action with respect to
<br />shop drawings, samples, the acceptability of substitute materials and equi pment proposed by contractor(s),
<br />and other data that the contractor{s) are required to submit to ensure conformance to the Construction
<br />Drawings, Technical Specifications, General Conditions and Supplemental Conditions. Consultant shall
<br />complete its review of submittals, shop drawings, samples and other data so as not to delay the progression of
<br />the work, and in any event within fourteen { 14) calendar days of receipt. The City shall be entitled to rely upon
<br />the approval by Consultant that the shop drawings, product data, and samples approved by Consultant
<br />conform with the Technical Specifications, General Conditions, Supplemental Conditions and design specified
<br />in the Construction Drawings, as may be amended. Such reviews and approvals or other action shall not
<br />extend to the means, methods, techniques, sequences or procedures of construction or to safety precautions
<br />and programs incident thereto.
<br />1. 7 .8 . Consultant shall be obliged, in its role as the representative of the City on the project, to
