prior to final inspection, prepare and deliver for the final approval and written acceptance of the City •as built" <br />drawings in signed and sealed hard copy and an electronic format acceptable to the City (latest AutoCAD <br />Release) on State Plane Coordinates; and (4) conduct a final inspection to determine if the completed work is <br />in compliance with the punch list, "as-built" drawings" and the Construction Drawings, Technical Specifications, <br />General Conditions and Supplemental Conditions. Within three (3) business days following such detennination <br />of compliance by Consultant, it shall recommend in writing final payment to the contractor(s) and shall give <br />written notice to City and the contractor(s) that the work is acceptable (subject to any conditions expressed in <br />such recommendation). <br />1.7.14. Consultant will make decisions in writing on all daims of the contractor(s), and on all other <br />matters relating to the execution and progress of the work or the interpretation of the Construction Drawings, <br />Technical Specifications, General Conditions , Supplemental Conditions and contract documents. All such <br />decisions of Consultant shall be final. <br />1.7.15. In the event of any unresolved dispute between City and its contractor(s), Consultant shall <br />serve as mediator during a mediation meeting with City and contractor(s). Notwithstanding the foregoing, <br />Consultant will not be an arbitrator of disputes between City and its contractor(s). <br />1. 7.16 Deliverables. Consultant shall provide to City: <br />(a) Weekly meeting minutes; <br />{b) Transmittal of maintenance and operating instructions , schedules, guarantees, bonds and <br />certificates of inspection, tests and approvals {assembled by contractor(s)) with written comments and, if <br />applicable, recommendations regarding same: <br />(c) Punch list of items to be completed by Contractor after substantial completion; <br />{d) "As built" drawings in signed and sealed hard copy and an electronic format acceptable to <br />the City (latest AutoCAD Release) on State Plane Coordinates; and <br />(e) Recommendation of final payment to the contractor(s) and written notice to City that the <br />work is acceptable. <br />1. 7 .17. If requested by City, Consultant shall attend Board meeting( s) and may be asked to make <br />presentations of the project status or any Issues or concerns. Consultant will not be compensated for <br />attendance at Board meetings unless explicitly requested In writing by City to attend. <br />1.8 Non-Exclusive <br />This is a non-exclusive Agreement and the City may secure similar or identical services from other <br />professionals. <br />1.9 Work Authorizations <br />City: <br />1.9 .1 For each task or assignment, the City shall request Consultant to develop for review by the <br />(i) a scope of services in accordance with the applicable phases of Professional Services <br />described in Section 1.1 of this Agreement. Consultant shall describe the Professional <br />Services utilizing the categories established in Section 1 of this Agreement; <br />(ii) an estimate of fees and costs base on the hourly rates established in this Agreement ; <br />(iii) a task/deliverable schedule; and <br />(iv) a payment schedule based on deliverables <br />1.9.2 The City and Consultant may negotiate scope definition and fees (at the agreed hourly rates) <br />for each work authorization. Upon mutual agreement of the scope of services , fees and costs, task/del iverable <br />schedule and payment schedule , a written work authorization for each task shall be executed by Consultant <br />and City.
