bond in an amount specified in the franchise agreement or other authorization as necessary to ensure <br /> the franchisee's faithful performance of the construction, upgrade, rebuild or other work. <br /> construction, upgrade or other work in the streets in a safe, timely and competent manner in <br /> accordance with the provisions of the franchise agreement, there shall be recoverable, jointly and <br /> severally from the principal and surety of the bond, any damages or loss suffered by the City as a <br /> result, including the full amount of any compensation, indemnification er cast of removal or <br /> abandonment of any property of the franchisee, or the cost of completing or repairing the system <br /> against the security fund pursuant to § 113 12 hereof where such amount exceeds-that available under <br /> the security fund. <br /> C. The franchise agreement may specify that upon completion of the system construction, upgrade, <br /> the satisfaction of the City, the City may eliminate the bond or reduce its amount. However, the City <br /> may subsequently require an increase in the bond amount for any subsequent construction, upgrade, <br /> rebuild or other work in the streets. <br /> D. The construction bond shall be issued by a surety having a minimum rating of A 1 in Best's Key <br /> - z -- • . • <br /> shall provide that: "This bond may not be canceled, or allowed to lapse, until 60 days after receipt by <br /> the City, by certified mail, return receipt requested,of a written notice from the issuer of the bond of <br /> intent to cancel or not to renew." <br /> E. The rights reserved by the City with respect to any construction bond established pursuant to this <br /> agreement, or at law or equity. <br /> § 113-14. - Minimum facilities and services. Reserved. <br /> A. The following minimum requirements for facilities and services apply to all franchises granted by <br /> the City. The City may require in a franchise agreement that a franchisee exceed these minimum <br /> requirements where it determines,under circumstances existing at the time of the application,that the <br /> additional requirements are r-asonable to meet the City's future cable related needs and interests or to <br /> rebuild, upgrade or reconstruction after the effective date of this chapter shall have a minimum <br /> capacity of at least 750 MHZ providing no less than 78 video channels available for immediate use. <br /> A franchise agreement may provide for a larger minimum channel capacity requirement. <br /> (2)The City may require in a franchise agreement that a franchisee provide access channels, facilities <br /> (3)At the City's request, a franchisee shall provide cablecasting of City Commission meetings live to <br /> all subscribers located within the City. <br /> (1) A cable system shall provide 1-ased access channels as required by federal law. <br /> technically feasible, at least one additional outlet equipped for on line ac - . • ..• - - . <br />
