Agenda Item No. 8(Q)(1) <br /> Page No. 2 <br /> WHEREAS, on March 1, 2011, the Board, through Resolution R-137-11, authorized the <br /> execution of a lease agreement (the "2011 Lease Agreement") between the County and the City, <br /> which provided the framework for the construction of a passive park, fencing, landscaping and <br /> other improvements on a 7,372 square foot parcel of the Property; however, because the initial <br /> term of the 2011 Lease Agreement expired before any improvements to the Property were made <br /> by the City,the County and the City negotiated the attached New Lease Agreement, which allows <br /> the City to expand the square footage area of the passive park from 7,372 square feet to 17,651 <br /> square feet; and <br /> WHEREAS, this Board finds that, pursuant to Section 125.38 of the Florida Statutes, the <br /> property to be leased to the City is not needed for a County purpose and will be used by the City, <br /> pursuant to the lease, for a use that will promote the community interest and welfare; and <br /> WHEREAS, the Board desires to accomplish the purposes outlined in the accompanying <br /> memorandum, a copy of which is incorporated herein by reference, <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF MIAMI-DADE COUNTY,FLORIDA, that: <br /> Section I. The foregoing recitals are incorporated in this resolution and are approved. <br /> Section 2. The Board hereby approves, pursuant to Section 125.38, Florida Statutes, <br /> the New Lease Agreement between Miami-Dade County and the City of Sunny Isles Beach, a <br /> Florida municipal corporation, for premises located at 350 Sunny Isles Boulevard, Sunny Isles <br /> Beach, Florida to be utilized as a passive park for an initial term of 20 years with two 10-year <br /> options to renew and an annual rent of$10.00, in substantially the form attached hereto and made <br /> a part hereof. <br /> 9 <br />
