City of Sunny Isles Beach |Request for Proposals No. 18‐11‐02 13 <br /> <br /> <br />If any insurance should be canceled or changed by the insurance company or should any <br />insurance expire during the period of this contract, the Contractor shall be responsible for <br />securing other acceptable insurance for the coverage specified in this section in order to <br />maintain coverage during the life of this Contract. All deductibles must be declared by <br />the Contractor and must be approved by the City. At the option of the City, either the <br />Contractor shall eliminate or reduce such deductible or the Contractor shall procure a <br />Bond, in a form satisfactory to the City, covering the same. <br /> <br />2.9.2 INSURANCE – SUBCONTRACTORS <br />Contractor shall require all of its subcontractors to provide the aforementioned coverage <br />as well as any other coverage that the contractor may consider necessary, and any <br />deficiency in the coverage or policy limits of said subcontractors will be the sole <br />responsibility of the contractor. <br /> <br />2.10 FEDERAL AND STATE REGULATIONS <br /> <br />The Contractor shall comply with all applicable federal, state and local rules and regulations <br />regarding provision of Services. <br /> <br />2.11 LICENSES, PERMITS AND TAXES <br /> <br />Contractor shall, at its own expense, obtain all necessary permits and licenses, pay all applicable <br />fees, and pay all applicable sales, consumer, use and other taxes required to comply with local <br />ordinances, state and federal law. Consultant is responsible for reviewing the pertinent state <br />statutes regarding state taxes and for complying with all requirements therein. Any change in tax <br />laws after the execution of this Agreement will be subject to further negotiation and Consultant <br />shall be responsible for complying with all state tax requirements. <br /> <br />2.12 GENERAL REQUIREMENTS <br /> <br />Bus Shelters must be engineered and built to meet or exceed all applicable building codes, wind <br />loads, and seismic load specifications and to be in full compliance with ADA Accessibility Code. In <br />all locations designated for the installation of a new shelter, bench and/or trash receptacle, the <br />contractor shall be responsible for the purchasing, transport, storage, layout, approval and <br />installation of the product at each bus stop location. The layout of the all products shall ensure <br />that American with Disabilities Act (ADA) compliance is attained at the bus stop location and shall <br />be approved by the City prior to final installation. <br /> <br />2.13 MONTHLY INVOICES PAYMENTS <br /> <br />Payment terms will be considered to be net 30 days after the date of satisfactory delivery at the <br />place of acceptance and receipt of correct invoice at the office specified, whichever occurs last. <br />Bidder may offer cash discounts for prompt payment but they will not be considered in <br />determination of award. <br />
