RECITALS: WHEREAS, Grantor is the owner of a certain property situated in Sunny Isles Beach, Miami-Dade County, Florida, and more particularly described in Exhibit"A" (the "Easement Parcel") attached hereto; and WHEREAS, the Grantee is seeking to construct a Pedestrian Overpass Bridge connecting west side of Collins Avenue to the east side of Collins Avenue to be used for pedestrians (the "Pedestrian Bridge"); and WHEREAS, Grantor has agreed to grant and create, and Grantee, desires to obtain, on the terms and condition hereinafter set forth, an easement over, across, and under and through the Grantor's property for the purposes of installing, maintaining and repairing all necessary utility lines,pipes, services and appurtenances. NOW THEREFORE, Grantor, in consideration of ten ($10.00) Dollars and for other good and valuable consideration, the receipt and sufficiency of which are herby acknowledged, Grantor and Grantee hereby agree as follows: 1.
