If controlling law changes to require the licensee, or to authorize the City to require the licensee, to <br /> provide telecommunications services or facilities to schools, hospitals, government or other public <br /> § 129-47. - Insurance. Reserved. <br /> A. The licensee shall provide, pay for and maintain, throughout the term of its license, and with <br /> companies satisfactory to-the City, the types of insurance described herein. All insurance shall be <br /> licensee shall be approved by the City Manager. All liability policies shall provide that the City is <br /> an additional insured as to the operations under this license and shall provide the severability of <br /> interest provision. The required coverages must be evidenced by properly executed certificates of <br /> insurance licensee. Thirty days' advance written notice by registered or certified mail must be given <br /> to the City of any cancellation, intent not to renew or reduction in the policy coverages, which <br /> notice shall be sent by registered mail to the Administrative Services Department. Companies <br /> issuing the insurance policies shall have no recourse against the City for payment of any premiums <br /> B. The limits of coverage of insurance required shall be not less than the following: <br /> employer's liability insurance with limits of not less than $500,000. This coverage must be <br /> evidence by a certificate of insurance that requires at least 30 days' advance written notice of <br /> cancellation, nonrenewal or material change to the City Manager. <br /> (2) Comprehensive general liability bodily injury and property damage $.1,000,000 <br /> combined single limit -ach occurrence. <br /> (3) Automobile-iabi1ity=—bed-il-y njury and property damage $1,000,0 -si+gle <br /> limit each accident covering all owned, nonowned, and hired vehicles. <br /> C. Upon 30 days' notice, the insurance coverage and policy requirements may be changed and <br /> expesufe-a,,d l; itom <br /> D. These insurance requirements may be met by evidence of participation of a bona fide captive <br /> insurance or self insurance program that is established and regulated by a governmental entity. <br /> - - E. The City may, at its option, increase or decrease policy limits set forth above, upon 60 days' <br /> written notice to the licensee. Within 60 days from receipt of notice to incr ase its policy limits, the <br /> § 129-48. - Faithful performance and payment bond. Reserved. <br /> The licensee shall within 30 days of the effective date of a license granted under this article, furnish <br /> to the Administrative Services Department a performance bond or an irrevocable letter of credit <br /> bond shall be maintained by the licensee throughout the term of the license. <br /> licensees' system installed in the City's streets, and for one year after the license expires or is <br /> terminated. The bond shall contain a provision that it shall not be terminated or otherwise allowed <br /> to expire without 30 days' prior written notice first being given to the Director and the Risk <br /> Manager.
