84CES Consultants ● City of Sunny Isles Beach RFQ No. 18-11-01 <br />LITIGATIONSTATEMENT <br />CES Consultants, Inc. is not involved in current/pending or past litigation/arbitration in the last three 5 years, arising out of our <br />performance. However, below we have provided ALL cases for the past five years, above and beyond the RFP request. <br />Case: Veneisy Andrade v. CES Consultants, Inc; Case Number 2018-016690-CA-01; 5/18/2018. Claims for Discrimination – <br />Employment or Other. <br />Response: This case is an employment that is unrelated to performance on any project or contract and unrelated to any client. <br />Case: Veneisy Andrade v. CES Consultants, Inc. and Rudy Ortiz; Case NO: 17-CV-23655; 10/05/2017. Claims for FLSA Overtime Wage <br />Violation(s), Breach of Contract, Promissory Estoppel. <br />Response: This case is an employment that is unrelated to performance on any project or contract and unrelated to any client. <br />Case: AA Moped Motorsports of MIA, Inc. v. Sim G Technologies and CES Consultants, Inc., 10-035514-CA-01 6/25/2010 Claim for <br />failure to timely perform contract Dismissed for lack of prosecution on 7/27/2015 <br />Response: This case resulted from a contract owned by a company, Sim G. Technologies (llc), which was acquired by CES in 2008. <br />This contract was not included in the transfer of assets to CES as part of the acquisition. CES was however named in the lawsuit, <br />nevertheless, the case was dismissed without findings or judgements against CES, or payment by CES. <br />Case: Aerotek, Inc. v. CES Consultants, Inc., 12-008429-CC-25 12/13/2012 Contract indebtedness/failure to pay subconsultant <br />Judgment entered against CES on 2/20/13 <br />Response: This case is unrelated to performance on any project or contract, and unrelated to any client. Nor was the case ever <br />litigated. This case resulted from a dispute on charges made by Aerotek, a staffing agency, not a subconsultant, which, in the <br />interest of time and resources, CES followed council advice agreeing to payment despite the fact that the claim was invalid. <br />These two cases are related to the same automobile accident: <br />Case (1 of 2): Brandy Love v. Raymond F. Davidson and CES Consultants, Inc., Case No. 2012CA007340 filed on April 16, 2012 in the <br />15th Judicial Circuit for Palm Beach County <br />Response: This case is unrelated to performance on any project or contract, and unrelated to any client. Nor was the case ever <br />litigated. This case relates to an automobile accident by an employee of CES which was handled in mediation by attorneys <br />representing our Automobile insurance carrier.
