RESOLUTION NO. 2013- -RD cg A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A REQUEST SUBMITTED BY LPLA PARTNERS, LP TO USE THE LOT AT THE REAR OF THE WALGREENS LOCATED BETWEEN 174TH STREET AND 175TH STREET FOR TEMPORARY PARKING FOR CONSTRUCTION WORKERS; ESTABLISHING CONDITIONS FOR THE USE OF THE LOT FOR TEMPORARY PARKING; PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION.; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on or about May 7, 2013, LPLA Partners, LP ("Applicant") submitted an application to the City of Sunny Isles Beach. Florida requesting the use of the lot at the rear of Walgreens located between 174th Street and 175th Street for temporary parking for construction workers: and WHEREAS. the City Commission wishes to approve the use of the lot at the rear of Walgreens for temporary parking lot and permit temporary egress and ingress through the City parking lot located at 175 Street. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they are fully set forth herein. Section 2. Temporary Use. Pursuant to Section 265-14 of the City Code. the City Commission hereby approves subject to the conditions below the temporary use application submitted by LPLA Partners. LP to use the Walgreens' rear lot for temporary parking for construction workers for a period of time not to exceed April 30, 2015. The City Commission hereby further approves the use of the public parking lot located on 175 Street for egress and ingress to the Walgreens' rear lot. Section 3. Conditions of Approval. The Applicant is required to comply with the following conditions: 1. The temporary parking lot at the Walgreens' rear lot located between 174th Street and 175th Street shall be fenced to serve only employees of the Applicant or its construction company and egress and ingress shall not be provided through the Walgreens' main lot. 2. The Applicant's use of the City's parking lot for egress and ingress purposes shall not interfere with the existing public use of the parking lot.
