A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, ACCEPTING THE RESULTS OF
THE SPECIAL ELECTION HELD ON TUESDAY, JUNE 4, 2013, ON
PROPOSED AMENDMENTS TO THE CITY CHARTER; DISCHARGING
THE CANVASSING BOARD; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on Tuesday, June 4, 2013, the City of Sunny Isles Beach held a Special
Election on proposed Amendments to the City Charter; and
WHEREAS, the City Commission desires to accept the results of the Special Election held
on June 4, 2013.
BE IT RESOLVED BY THE CITY COMMISION OF THE CITY OF SUNNY ISLES
BEACH, FLORIDA, AS FOLLOWS:
Section 1. Accept Results of Special Election. The City Commission of the City of Sunny
Isles Beach hereby accepts the results of the Special Election held on June 4, 2013, as follows:
1. Requiring proof of residency for candidates for Commissioner or Mayor at
time of qualifying: The City Charter does not contain specific provisions
requiring proof of residency for candidates for Commissioner or Mayor at the
time of qualification. It is hereby proposed that candidates submit specific
proof of residency at the time of qualifying by producing a valid voter's
registration card and other documents which establishes compliance with
residency requirements for the office of Commissioner or Mayor. This
amendment requires the City Commission to establish specific residency
requirements by Ordinance.
Shall the above described amendment be adopted?
Yes 452 votes
No 6 votes
2. Requiring consent of the City Commission to hire or terminate the Chief of
Police: The City Charter currently requires that the City Manager shall be
responsible for the appointment, supervision and removal of all City
employees except for the Office of the City Attorney and his/her staff It is
hereby proposed that the consent of the City Commission be necessary to hire
or fire the Police Chief, provided that the City Manager is responsible for the
supervision of the Police Chief.
Shall the above described amendment be adopted?
Yes 395 votes
No 67 votes

3. Authorizing the Charter Revision Commission to select its own Chairperson:
The City Charter currently does not contain a provision authorizing the
Charter Revision Commission to select its own Chairperson. It is hereby
proposed that the Charter be amended to permit the Charter Revision
Commission to select its own Chairperson.
Shall the above described amendment be adopted?
Yes 348 votes
No 107 votes
4. Authorizing the Charter Revision Commission 120 days to submit proposed
amendments to the City Commission: The City Charter currently requires the
Charter Revision Commission to draft any proposed amendments to the
Charter and submit same to the City Commission no later than 90 days after
the Charter Revision Commission is appointed by the City Commission. It is
hereby proposed that the Charter Revision Commission have 120 days, instead
of 90 days, after being appointed, to submit any proposed amendments to the
City Commission.
Shall the above described amendment be adopted?
Yes 340 votes
No 104 votes
5. Deleting the requirement that the City use Miami-Dade Fire Rescue
Department: The City Charter currently requires that the City shall utilize the
services of the Miami-Dade Fire Rescue Department to provide fire and rescue
services to the City. It is hereby proposed that this requirement be eliminated.
Shall the above described amendment be adopted?
Yes 194 votes
No 252 votes
6. Correcting scrivener's errors: The City Charter currently contains certain
sections with minor scrivener's errors. There are also sections that need
clarification for legal sufficiency. It is hereby proposed that the Charter be
amended for clarification purposes and to correct grammatical errors.
Shall the above described amendment be adopted?
Yes 416 votes
No 24 votes
Section 2. Discharge of the Canvassing Board. The City Commission of the City of Sunny
Isles Beach hereby discharges the Canvassing Board being Emanuel Pine, Member; City
Manager Christopher J. Russo, Member; and City Clerk Jane A. Hines, Chairperson, as the City
• of Sunny Isles Beach's Canvassing Board for the Special Election held on June 4, 2013.

Section 3. Effective Date. This Resolution shall become effective immediately upon
adoption.

RE: Resolution Accepting the Results of the Special Election Held
on June 4, 2013 to Consider Proposed Amendments to the
City Charter
RECOMMENDATION:
It is requested that the City Commission adopt the attached Resolution accepting
the results of the Special Election held on June 4, 2013.
REASONS:
The Canvassing Board for the Special Election held on June 4, 2013 has
completed the canvassing and hereby needs to be discharged consisting of
Resident Emanuel Pine, City Manager Christopher J. Russo, and City Clerk Jane
A. Hines. The Miami-Dade County Elections Department has issued the official
results on the following proposed amendments to our Charter:
1) Requiring proof of residency for candidates for Commissioner or Mayor at time
of qualifying;
Shall the above described amendment be adopted? Yes 452 votes; No 6 votes
2) Requiring consent of the City Commission to hire or terminate the Chief of
Police;
