HomeMy WebLinkAboutReso 2013-2076 RESOLUTION NO. 2013-26% A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ACCEPTING THE FINAL RE-PLAT FOR TERRA BEACHWALK, LLC A/K/A ATLANTIC 15 FOR THE PROPERTIES LOCATED AT 18915, 18925, 18955, 18965, 18985, 19001, 19025, AND 19035 ATLANTIC BOULEVARD (THE "PROPERTY"); PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on November 2, 2012, Terra Beachwalk, LLC. (the "Applicant") applied for a Subdivision Plat in order to divide eight parcels into fifteen (15) fee simple single-family houses units and other improvements upon the Property, and WHEREAS, by Resolution No. 12-Z-135, adopted on December 20, 2012, the City Commission approved a site plan filed by Terra Beachwalk, for 15 single-family residences to be located on the Property; and WHEREAS, the Miami-Dade County Plat Committee has approved the re-plat submitted by Terra Beachwalk for the Property; and WHEREAS, Terra Beachwalk, now presents to this Commission, in accordance with Chapter 28 of the Code of Miami-Dade County, a final re-plat of certain lands lying in the City of Sunny Isles Beach as more particular described in Exhibit "A"; and WHEREAS, the City Commission wishes to approve the final re-plat approved by Miami- Dade County pursuant to Section 265-17 of the City Code. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPLICABLE TO APPLICANT, ITS SUCCESSORS, OR ASSIGNS, AS FOLLOWS: Section 1. Final Plat Approval. Pursuant to Section 265-17 of the City Code, the City Commission hereby approves the final re-plat filed by Terra Beachwalk for the properties located at 18915, 18925, 18955, 18965, 18985, 19001, 19025, and 19035 Atlantic Boulevard. Section 2. Authority of the City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. David, City Planning Consultant DATE: 6/20/2013 RE: Final Re-Plat for Beachwalk a/k/a Atlantic 15 RECOMMENDATION: This Resolution is presented for your consideration REASONS: On December 20, 2012 Terra Beachwalk, LLC was granted site plan approval for 15 single family residences by the City Commission pursuant to Resolution 12-Z- 135. Condition 3 of said Resolution stated: "That the Applicant shall obtain all approvals necessary in connection with replatting of the property prior to the commencement of building activity. If the City and County do not approve the re-plat any approvals granted by this application shall be made null and void." The Applicant has completed the platting process with Miami-Dade County. Additionally, the Applicant has received approvals necessary from the various utilities and is therefore requesting approval of this re-plat from eight lots to 15 in order to construct the 15 single-family residences that were previously approved. _Pursuant to Section 265-17 of the City Code, the City Commission is required to approve the final re-plat.
