HomeMy WebLinkAboutOrdinance 2013-406 ORDINANCE NO. 2013 - L►p t, AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-45 OF THE CITY CODE RELATING TO FENCES ON RESIDENTIAL LOTS TO PROVIDE THAT FENCES OR WALLS CONSTRUCTED BY THE CITY FOR PUBLIC PURPOSES MAY EXCEED SIX (6) FEET IN HEIGHT TO A MAXIMUM OF EIGHT (8) FEET IN HEIGHT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the purpose of this Ordinance is to provide an exception to the requirement set forth in Section 265-45`that fences or walls on a residential lot be limited to six (6) feet in height; and WHEREAS, the City wishes to amend Section 265-45(E) to provide an exception to the six feet height requirement, to provide that fences or walls constructed by the City for beautification purposes may exceed six feet in height. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Section 265-45 of the City Code is amended to read as follows: § 265-45. Accessory uses. E. Fences and walls. (1) Defined. A fence or wall is a barrier constructed of man-made or natural materials. A wall is a concrete or block structure. (2) Fences on residential lots. Fences on a residential lot shall be limited to six feet in height except fences or walls constructed by the City for public purposes may exceed six (6) feet in height to a maximum of eight (8) feet in height. Barbed wire and other similar material shall not be permitted on a fence or wall within a residential district. Fences and walls shall be limited to four feet in height within a required front yard, except that fences with decorative railings shall be limited to six feet in height. Such railings shall be a minimum of six inches apart and shall not obstruct the view from the rights-of-way. In all zoning districts, only pressure-treated pine, redwood and cedar wood shall be acceptable for wood fence construction. All wood fencing shall have a nominal thickness of one inch. Each side of a concrete block or masonry wall shall be completely finished with stucco and/or paint. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion In The Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed Section 6. Effective Date. This Ordinance shall become effective upon adoption on second reading. PASSED and ADOPTED on first reading the I US' day of Y1'1 y' 2013. DATE: June 20, 2013 RE: Amending Chapter 265-45 of the City Code Relating to Fences/Walls RECOMMENDATION: This Ordinance is presented for your consideration and approval. REASONS: In order for the City to construct beautification walls at the Arlen House Condominium, the City Code must be amended to permit walls over six (6) feet in height.
