HomeMy WebLinkAboutOrdinance 2013-407 ORDINANCE NO. 2013 - 4 t J AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265 "ZONING" SECTION 265-34 OF THE CITY CODE TO CLARIFY PERMITTED RETAIL AND OFFICE USES WITHIN THE MEDIUM- HIGH DENSITY MULTIFAMILY RESIDENTIAL (RMF-2) DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the purpose of this Ordinance is to promote the public health, safety and welfare of the residents of the City of Sunny Isles Beach in the use and development standards for multi-family and hotel uses within the City which from time to time need to be clarified and adjusted; and WHEREAS, from the inception of the City, limited retail and office uses have been permitted within the Medium-High Density Multifamily Residential (RMF-2) district and such uses are customary and appropriate uses when properly restricted; and WHEREAS, on , 2013, the City Local Planning Agency, pursuant to Section 57-2 of the City Code, reviewed and made recommendations regarding the proposed amendments to the City land development regulations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Chapter 265, "Zoning", Article VII "Zoning Districts", Section 265-34 of the City Code is amended to read as follows: § 265-34. - Medium - High Density Multifamily Residential (RMF-2). A. Purpose. The Medium - High Density Multifamily Residential (RMF-2) District provides for single-family, duplex, townhouse, medium-density and high-density residential development of multifamily dwellings at a maximum density of 60 dwelling units per net acre consistent with the City's Comprehensive Plan Land Use Element and the corresponding Medium - High Density Residential land use category. The uses within this district shall be consistent with, but may be more restrictive than the Medium - High Density Residential Land Use category permitted uses. B. Uses permitted. No building or structure, or part thereof, within the district shall be erected, 1 altered or used, or land used in whole or in part for other than one or more of the following specific uses, subject to all other applicable standards and requirements contained in this chapter: (1) All uses permitted in RMF-1 district. (2) Uses customarily incidental and accessory to any of the above uses when located on the same plot. (3) Wet dockage or moorage of private, noncommercial, pleasure craft in connection with any residential use permitted. (4) Convenience retail and office uses in condominium commercial units, provided that such uses primarily serve the residents and guests of the condominium, no signage is visible from the public right of way except for signage approved under this Chapter, consent of the condominium association is required where the commercial unit is within a condominium, the uses create no negative parking impacts on the required parking of the condominium, and any services provided to by such uses to the public must be incidental. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion In The Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word, as required. Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed Section 6. Effective Date. REASONS: The purpose of the attached Ordinance is to clarify in the City Code that commercial units in condominiums located in the RMF-2 District are required to primarily serve residents of the condominium and its guests. However, such commercial units may provide incidental services to the general public. This clarification Ordinance is required to prohibit expansion of commercial uses that are located in condominiums in the RMF-2 District. For example, the City received requests to open a traffic school, law offices, and cosmetology within commercial units in a condominium located in the RMF-2 District. Clearly, a traffic school is not created for purposes to serve only residents. For information purposes, condominiums within the RMF-2 District are Arlen House, Ocean Reserve, Winston Towers, and KingsPoint. This Ordinance does not apply on a retroactive basis.
