A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, APPROVING A
REQUEST SUBMITTED BY FORTUNE INTERNATIONAL TO
WAIVE THE LANDSCAPING REQUIREMENT FOR THE
CONSTRUCTION FENCE AT THE JADE SIGNATURE
•
PROJECT LOCATED AT 16901 COLLINS AVENUE;
ESTABLISHING CONDITIONS FOR THE RELOCATION OF
THE CONSTRUCTION FENCE; PROVIDING THE CITY
MANAGER AND CITY ATTORNEY WITH THE AUTHORITY
TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on or about June 24, 2013, Fortune International ("Applicant") submitted a
request to the City of Sunny Isles Beach, Florida to waive the landscaping requirement at the
construction fence for the Jade Signature project to facilitate the installation of the underground
garage; and
WHEREAS, the City Commission wishes to approve the waiver to permit the Applicant
with the flexibility to install the underground parking garage.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are
incorporated herein by reference as if they are fully set forth herein.
Section 2. Waiver. The City Commission hereby approves the waiver of the landscape
requirements set forth in Section 265-63.3 E. of the City Code, subject to the conditions below.
Section 3. Conditions of Approval. The Applicant is required to comply with the following
conditions:
1. The construction fence shall be relocated to the front property line and maintain in
good condition.
2. The Applicant shall provide to the City the amount of Five Thousand Dollars ($5,000)
for City cultural programs. The amount of $5,000 shall be paid within five (5)
business days of approval of this Resolution.
Section 4. Authority of the City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 5. Effective Date. This Resolution shall become effective upon adoption.
PASSED AND ADOPTED this 18th day of July 2013.

RE: Request to Waive Landscaping Requirement for the Construction
Fence at Jade Signature
RECOMMENDATION:
Adopt the Resolution approving the request from Fortune International to waive .
the landscaping requirement at their temporary construction fence.
REASONS:
Fortune International ("Applicant") has requested approval to waive the
landscaping requirement at their temporary construction fence to facilitate the
installation of the underground garage for the approved project Jade Signature
located at 16901 Collins Avenue. The Applicant agrees to the conditions
stipulated under the attached Resolution and agrees to pay $5,000 for
recreational and cultural purposes.
