HomeMy WebLinkAboutReso 2013-2125 RESOLUTION NO. 2013- 21 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN AGREEMENT WITH RIC-MAN INTERNATIONAL, INC. FOR CONTINUING SERVICES FOR SMALL CONSTRUCTION PROJECTS FOR FISCAL YEAR 2013/2014, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED THOUSAND DOLLARS ($100,000.00); AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City is in need of a general contractor to provide continuing services, on an as-needed basis, for small construction projects in the City; and WHEREAS, Ric-Man International, Inc. has expressed the ability and desire to provide these services pursuant to the terms and conditions of the City of Weston Bid No. 2012-03; and WHEREAS, the City wishes to enter into an Agreement with Ric-Man International, Inc. to provide continuing services on an as-needed basis for small construction projects in the City, in a total amount not to exceed One Hundred Thousand Dollars ($100,000.00), commencing from the issuance of a Notice to Proceed and shall terminate one (1) year afterwards with an option of four (4) additional one (1) year renewal terms. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Agreement. The City Commission hereby approves the Agreement with Ric-Man International, Inc. for continuing services on an as-needed basis for small construction projects in the City for Fiscal Year 2013/2014, in an amount not to exceed One Hundred Thousand Dollars ($100,000.00). Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. This Resolution shall become effective upon adoption. CONTRACT NO. C1213-081 This First Amendment to the Agreement between the City of Sunny Isles Beach and Ric- Man International, executed this day of October, 2013, is made a part of the original Agreement ("the Agreement") between the City of Sunny Isles Beach ("City") and Ric-Man International, Inc. ("Contractor") attached hereto as Attachment `B", whose Federal Identification#is 501'9'-13?P . The City and Contractor hereby agree as follows: 1. OPTION TO RENEW. The City hereby exercises its first optional fiscal year renewal term for the period ending September 30, 2014, in accordance with Section 4 of the original Agreement. 2. COST. The payments to the Contractor, as set forth in Section 5 of the original Agreement, is hereby amended to include additional compensation for the Services in an amount not to exceed One Hundred Thousand Dollars ($100,000.00) for the fiscal year ending September 30,2014. 3. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein,all terms and conditions of the original Agreement between the parties shall remain in full force and effect. 4. CONFLICTING PROVISIONS. The terms and conditions in this First Amendment supersede any other conflicting provisions that are contained in any other document. If there is a conflict or inconsistency between any term, statement, requirement, or provision of this First Amendment and any other document,the term,statement,requirement,or provision contained in this First Amendment shall prevail and be given superior effect and priority. Russo, City Manager FROM: Helen Gray, PE, City Engineer DATE: 10/17/2013 RE: A Resolution Authorizing the City Manager to Utilize Ric-Man International, Inc. for Various Citywide Projects IIIRECOMMENDATION: We recommend City Commission approve the resolution. REASONS: In May 2013, City Commission approved an increase to the aggregate cost threshold for City Manager approval from $25,000 to $100,000 per fiscal year for Ric-Man International, Inc. utilizing a unit price contract. That Commission approval was further limited to FY12/13 only to allow for a review and evaluation on how this increased authority was being implemented. In FY12/13, the following work was approved under this authority: Bella Vista Bay: $3,790.00 for interim storm drainage improvements and limited site grading needed to safe up the site. 183rd Street: $3,553.00 for the replacement of the top slab and frame and grate for an inlet that had deteriorated to a point of near failure. Samson Park: $5,007.50 for removal of obstructions in the sanitary sewer lateral that had rendered the public restrooms inoperable in June. • Samson Park: $1,018.00 for removal of additional obstructions that had been introduced to the sanitary sewer lateral that had rendered the public restrooms Agenda Item No IOD Date 10/17/2013 166 • inoperable in August. Pier Park: $1,174.50 for miscellaneous paver repairs in the parking lot that had not been covered under contracts with the pier reconstruction contractor or underground utility contractor (potable water). Intracoastal Park: $2,917.25 for the transport of unused paver cubes to the Public Works yard left on-site by the Collins Avenue Streetscape contractor along with the removal and disposal of associated debris. North Bay Road Drainage: $41,668.00 for the repair and/or replacement of storm drainage pipe, and relining six manholes at three different locations, being just north of SR826 and in the vicinity of Gwen Margolis Park . The work also included reconstruction of the roadway surfaces at each of the three locations. In FY12/13, a total of $59,128.25 was authorized for services performed by Ric- Man International, Inc. Allowing for this procurement authority for FY13/14 will allow for continued and timely response to various problems as they arise.
