AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 197-18 OF
THE CITY CODE TO PREVENT ILLEGAL SURCHARGE FOR USE OF
CREDIT CARD BY CONSUMERS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS;
PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, the purpose of this Ordinance is to clarify penalties against businesses for
violating Section 501.0117, Florida Statutes; and
WHEREAS, Section 501.0117, Florida Statutes, makes it illegal for a business to impose
a surcharge on credit card payments by customers for goods and/or services, in lieu of paying by
cash or check; and
WHEREAS, in order to enforce this prohibition against charging surcharges on credit
card payments, in lieu of payments by cash or check, the City wishes to amend Section 197-18 to
specify that local business licenses may be revoked by the City for violations of Section
501.0117, Florida Statutes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific part by this
Ordinance upon adoption hereof.
Section 2. Amendment. Section 197-18 of the City Code is amended to read as follows:
The City Business Tax Officer is granted authority and is charged with the duty to revoke, refuse
to renew or suspend any receipt heretofore issued as follows:
A. Grounds. The following matters shall be taken into consideration as grounds for
revocation:
(1) The number, frequency, and severity of complaints received from the
public;
(2) The number, frequency, and severity of existing code violations;
(3) The number frequency and severity of similar prior code violations and or
complaints;
(4) The effects of continued uses and operations on the surrounding
properties, including the effect on occupants and tenants thereof;
(5) The effects of such continued uses and operations on the health and safety
of the residents and citizens of the City and general public;
(6) Any additional factors or considerations which may reasonably be
calculated to materially affect public health, safety and welfare;
(7) Any unlawful activity of federal, state, City or county law including but
not limited to violations of Section 501.0117, Florida Statutes, or other
violations of federal, state, or county criminal statutes, and/or violations of
county and/or City zoning, occupational licensing, and related ordinances;
(8) If the taxpayer permits premises to be utilized for solicitation for
prostitution, pandering, lewd and lascivious behavior, sale, distribution or
display of obscene materials or conduct; sale or possession of any
controlled substances or narcotic; and
(9) Failure of taxpayer to comply with any provision of this chapter.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and
if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion In The Code. It is the intention of the City Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny
Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to
accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other
appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed
Section 6. Effective Date. This Ordinance shall become effective upon adoption on second
reading.

RE: Ordinance Amending Section 197-18 of the City Code
RECOMMENDATION
This Ordinance is presented for your consideration.
REASONS
Recently, it came to staff's attention that one particular business in the City is charging our
senior residents a 25% surcharge for the use of a debit or credit card to purchase certain goods.
The imposition of such a surcharge is illegal and the violators may be guilty of a misdemeanor of
the second degree under Section 501.0117, Florida Statutes. Unfortunately, the State of Florida
has not sought to enforce this law.
To ensure compliance with Section 501.0117, Florida Statutes, the proposed ordinance will
specify that a violation of Section 501.0117 may result in the revocation of a business license
after the appropriate warning notice. Seeking criminal penalties for such violation may not be the
solution where such violator may not be aware of the prohibition. The City can provide such
warning notices to protect the general welfare.
This Ordinance was requested by Commissioner Jeanette Gatto.
