A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING
THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO
EXPEND UP TO TWENTY -FIVE THOUSAND DOLLARS
($25,000.00) FROM THE FEDERAL FORFEITURE (DOJ)
FUNDS FOR THE PURCHASE OF MISCELLANEOUS
TECHNOLOGY EQUIPMENT FOR LAW
ENFORCEMENT/INVESTIGATIVE PURPOSES TO BE USED
BY THE DEA/HIDTA PROGRAM; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, upon the
request of the Chief of Police to the governing body of a municipality, federally forfeited funds may
be expended if accompanied by written certification by the Chief of Police that the request complies
with the provisions of the Comprehensive Crime Control Act of 1984; and
WHEREAS, the Chief of Police has submitted a request for the expenditure of up to
Twenty -Five Thousand Dollars ($25,000.00) in federally forfeited funds in compliance with the
aforementioned.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification,
the Chief of Police is hereby authorized to spend up to $25,000.00 from the established Department
of Justice (DOJ) federal forfeitures account for the purchase of miscellaneous technology /electronic
equipment for law enforcement /investigative purposes (ie: Magtex Card Readers for police vehicles,
document scanners, computers /monitors, etc.) to be used by the Drug Enforcement Administration
High Intensity Drug Trafficking Areas Program (DEA /HIDTA).
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

(4) (a) and (4) (b), the above listed items meet the guidelines of purchase for law enforcement
purposes which include defraying the cost of protracted or complex investigation, or providing
for crime prevention, community policing projects.

RE: Approval to Expend Partial Forfeiture (DOJ) Funds to cover costs
of a change order for the upgrade of two Automatic License Plate
®
Reader Cameras and for the purchase of miscellaneous
technology equipment, in an amount not to exceed $25,000.00
RECOMMENDATION:
It is recommended that the City Commission approve the expenditure of partial
Federal (DOJ) Forfeiture Funds, previously awarded to the Police Department as
the results of investigative participation in forfeiture and seizure cases. These
funds are permissible by law to be spent for the purchases of police equipment
and other law enforcement activities. It is requested that we be permitted to
utilize up to $25,000.00 of said funds on deposit for such purpose.
REASONS:
The Sunny Isles Beach Police Department actively participates in DEA / FBI /
HIDTA (High Intensity Drug Trafficking Area) Initiative Group that conducts
numerous ongoing proactive investigations and has a need for the attached
listed equipment. These Items would be used to equip our internal Detective
Bureau as well as our Detached HIDTA Groups with some necessary equipment.
ADDITIONAL INFORMATION:
® One of the benefits of participating in and providing personnel into high intensity
narcotics investigations is the sharing of confiscated proceeds for the
