AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265
"ZONING" SECTION 265-35D(4) TO ADD SIDE YARD SETBACK
RESTRICTIONS IN THE MIXED USE — RESORT (MU-R) DISTRICT
FOR LOTS WITH FRONTAGE BETWEEN 211 FEET AND 299 FEET IN
ORDER TO PROVIDE AN OPTION FOR DESIGN FLEXIBILITY;
PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN
THE CODE; PROVIDING FOR REPEAL OF CONFLICTING
PROVISIONS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the purpose of this Ordinance is to promote the public health, safety and
welfare of the residents of the City of Sunny Isles Beach in the use and development standards
for multi-family and hotel uses within the City which from time to time need to be clarified and
adjusted; and
WHEREAS, the City desires to provide options for design flexibility in side yard
setbacks, for those existing lots or lots combined by unity of title that may range from 211 feet to
299 feet in frontage, in the Mixed Use —Resort (MU-R) District; and
WHEREAS, the City has determined that in order to be allowed to opt for such design
flexibility, the owner should provide support for the maintenance of adjacent beach access or
streetscape improvements; and
WHEREAS, the City Commission. acting as the City Local Planning Agency, pursuant
to Section 57-2 of the City Code, reviewed and made recommendations regarding the proposed
amendments to the City land development regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific part by this
Ordinance upon adoption hereof.
Section 2. Amendment. Chapter 265. "Zoning", Section 265-35(D)(4) is amended to read
as follows:
§ 265-35. Mixed Use - Resort District (MU-R).
. . . .Site development standards.
(4) Minimum setbacks.

(c) Interior side setbacks/view corridors.
[1] For parcels 200 feet or more in width:
[a] Primary structures. The minimum side setbacks for primary use structures exceeding
20 feet in height above grade shall be 50 feet. If side setbacks of different width are
provided, the larger setback shall be provided on the side adjacent to the public beach
access walkway or to provide for the greatest separation from buildings on adjacent sites.
Where a parcel is no more than five percent greater than 200 feet in width, the minimum
side setback shall be 20 feet.
[b] Pedestal structures, parking garages and accessory use structures. There shall be no
required setback for structures below six feet above grade. To preserve ocean view
corridors for sites west of Collins Avenue, for structures higher than six feet above grade,
there shall be a three-foot setback for each two feet of building height up to a maximum
setback of 50 feet.
[c] For parcels adjacent to public parks, excluding easements used exclusively for access,
the minimum side setback shall be five feet.
[d] Optional design flexibility side setback for parcels 211 to 299 feet in width:
At the option of the landowner, minimum setbacks may be provided as follows for
primary use structures exceeding 20 feet in height above grade on existing platted lots as of
December 1, 2013, or lots that may be combined subsequent to, for purposes of design
flexibility, and where the landowner provides to the City the designated fee payment for the
City's maintenance of adjacent public beach access, streetscape and park improvements.
This optional design flexibility setback requirement shall not apply to parcels 300 feet or
more in width.
[i] Minimum setback of 25 feet requires a fee payment of $1,000,000, per eligible
parcel.
[ii] Minimum setback of 30 feet requires a fee payment of $500,000, per eligible
parcel.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and
if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion In The Code. It is the intention of the City Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny
Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to
accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other
appropriate word, as required.

Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed
Section 6. Effective Date. This Ordinance shall become effective upon adoption on second
reading.

RE: Amending Chapter 265-35D (4) of the City Code
RECOMMENDATION:
This Ordinance is presented for your consideration.
REASONS:
Since the adoption of the City's Zoning Code in 2003, the City Commission has amended the
Zoning Code several times to provide design flexibility based on site conditions to enhance
architectural features of certain development projects. The attached Ordinance will provide
options for design flexibility in side yard setbacks for properties that have between 211 feet to
299 feet of frontage along Collins Avenue in the Mixed-Use Resort Zoning District. Specifically,
the Ordinance provide an optional design flexibility setback of 25 feet or 30 feet for properties
between 211 feet and 299 feet provided that a fee payment is made for maintenance of adjacent
public beach access, streetscape and park improvements.
The purpose of the attached Ordinance is to provide design flexibility for parcels within the
mixed-use district.
