HomeMy WebLinkAboutReso 2019-2920 RESOLUTION NO. 2019- 2i 20 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, EXPRESSING SUPPORT FOR FLORIDA SENATE BILL 76 AND FLORIDA HOUSE BILL 107 WHICH WOULD PROHIBIT THE USE OF WIRELESS COMMUNICATIONS DEVICES WHILE DRIVING; URGING THE FLORIDA LEGISLATURE AND GOVERNOR RON DESANTIS TO SUPPORT AND APPROVE THE LEGISLATION; DIRECTING THE CITY CLERK TO DISTRIBUTE COPIES OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Senator Wilton Simpson has filed Senate Bill 76, with co-introducers Senators Passidomo, Hooper, Mayfield, Book, Rouson, Berman and Perry for consideration by the Florida Legislature, and Representatives Jackie Toledo and Emily Slosberg have filed House Bill 107 which would amend Chapter 316 of the Florida Statutes to prohibit a person from operating a motor vehicle while listening or talking on a wireless communications device for the purpose of voice interpersonal communication; and WHEREAS, these proposed revisions to Chapter 316 of the Florida Statutes will assist in preventing crashes related to the act of using a wireless communications device while driving a motor vehicle; and WHEREAS, these bills will also delete the provision requiring that enforcement be accomplished only as a secondary action; and WHEREAS, it is in the best interests of the public throughout the state of Florida that the Florida Legislature adopt the proposed Senate Bill 76 and House Bill 107. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing"WHEREAS" clauses are hereby ratified and incorporated herein. Section 2. Support for Senate Bill 76 and House Bill 107. The City Commission hereby expresses support for Senate Bill 76 and House Bill 107 and urges the Florida Legislature to adopt and Governor Ron DeSantis to support and approve them. Section 3. Directions to the City Clerk. The City Clerk is directed to distribute copies of this Resolution to Senators Simpson, Passidomo, Hooper, Mayfield,Book, Rouson, Berman and Perry, Governor Ron DeSantis, the Speaker of the House of Representatives, the President of the Florida Senate,the Florida League of Cities, the Florida Association of Counties, the Florida City County Management Association, and the Miami-Dade County League of Cities. Russo, City Manager DATE: 2/21/2019 Resolution Supporting Florida Senate Bill 76 and House Bill 107 to Amend Section 316 of the Florida State RE: Statutes Prohibiting the Use of Wireless Communications Devices While Operating a Motor Vehicle L. RECOMMENDATION: It is recommended that the City Commission approve the proposed Resolution supporting Florida Senate Bill 76 and Florida House Bill 107 to prohibit the use of wireless communications devices while operating a motor vehicle. REASONS: Based on the need to protect the safety and welfare of pedestrians, and particularly due to recent accidents that have taken place in the City, both Vice Mayor Svechin and Commissioner Lama separately approached me regarding their support for these bills. The proposed legislation will prohibit the use of wireless communications devices while operating a motor vehicle and will delete the provision requiring that enforcement be accomplished only as a secondary action, which will authorize law enforcement officers to stop motor vehicles and issue citations to persons who are using a wireless communications device while driving. Additionally,the proposed bills stipulate that only in the event of a crash resulting in death or personal injury, will a users billing records for a 158 wireless communications device be admissible'ac evidence in any proceeding to determine whether a violation has been committed.
