HomeMy WebLinkAboutReso 2019-2973 RESOLUTION NO. 2019 - 2173 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, TO ACCEPT THE RECOMMENDATION OF THE CITY'S PUBLIC ARTS ADVISORY COMMITTEE ("PAAC") FOR APPROVAL OF ART IN PUBLIC PLACES APPLICATION NO. AP2019-01 SUBMITTED BY SUNNY ISLES PROPERTY VENTURE, LLC ("APPLICANT') FOR THE PLACEMENT OF A PABLO ATCHUGARRY SCULPTURE ON THE PROPERTY LOCATED AT 15701 COLLINS AVENUE; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on August 19, 2019, Sunny Isles Property Venture, LLC ("Applicant") submitted an application to the City's Public Arts Advisory Committee ("PAAC") for the placement of Dreaming the Future, a Pablo Atchugarry sculpture, on the property located at 15701 Collins Avenue; and WHEREAS, after the Applicant's presentation and reviewing the work of art, the PAAC recommends the City Commission approve Art in Public Places Application No. AP2019-01 submitted by the Applicant for the placement of a Pablo Atchugarry sculpture on the property located at 15701 Collins Avenue; and WHEREAS, the City Commission wishes to accept the recommendation made by the PAAC and approve Art in Public Places Application No. AP2019-01, as submitted by the applicant. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORDA, AS FOLLOWS: Section 1. Acceptance of Recommendation and Approval of Application. The City Commission hereby accepts the recommendation made by the PAAC and approves Art in Public , Places Application No. AP2019-01 as submitted by Sunny Isles Property Venture, LLC for the placement of a Pablo Atchugarry sculpture on the property located at 15701 Collins Avenue. Section 2. Authorization of the City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. This Resolution shall take effect immediately upon adoption. Russo, CityManager p • FROM: `.Javier Rabinovich, Chairman of PAAC • • DATE: 9/19/2019 Public Arts Advisory.Committee Recommendation:Art • RE: Application No.AP2019-01 - Ritz-Carlton Residences, 15701 Collins Avenue RECOMMENDATION: This Resolution is presented for your consideration. REASONS: On August 6, 2019, Applicant Sunny Isles Property Venture LLC sought approval from the PAAC for a Pablo Archugarry sculpture entitled "Dreaming the Future" to be located at 15701 Collins Avenue. After vigorous discussion by the PAAC, including consideration of comments from the Public Art Curator Dr. Long, the Applicant was advised that, while the piece of art itself was more than acceptable, the proposed location was not acceptable as the PAAC did not believe it • met PAAC Guidelines and the requirements and intent of the Art in Public Places Ordinance adopted by the City Commission. - The PAAC recommended two alternatives to Applicant for a more acceptable location and placement. At issue also was the actual value - - of the sculpture since certain items were included in the appraisal that the PAAC did not believe should have been included. Applicant said they would re-evaluate the valuation. Additionally, the Applicant requested that each PAAC member make a site visit to understand the site constraints between that meeting and a newly scheduled special meeting for August 19th for the purpose of reconsidering this issue. 62 The Committee members each visited the site and listened further to the Applicant's position on placement. 0 On August 19, 2019, the PAAC and the Applicant met •again j . collectively. The PAAC agreed the resubmitted appraisal was . • - acceptable. •However, once again, the PAAC unanimously concluded . the Applicant's preferred original placement was not. Prepared for that possibility, the Applicant presented its sketches on one of the two alternative locations suggested by the PAAC. The PAAC voted to accept this relocation with some conditions suggested by the staff, • including technical review and approval of the drawings based on landscaping and zoning requirements. Bythe time of this Commission meeting, staff will have completed that review. At this time, Staff has reviewed the proposed location and has no additional comments, the PAAC recommends-. approval of this application to the Commission.
