A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF
POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME
CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE FUNDS
FROM THE DEPARTMENT OF JUSTICE (DOJ) FOR ELECTRICAL
WORK AT TWO (2) AUTOMATIC LICENSE PLATE READER
LOCATIONS AND REMODELING OF THE POLICE DEPARTMENT
SUPPLIES,FOR HURRICANE PREPAREDNESS IN AN
AMOUNT NOT TO EXCEED SEVENTY THOUSAND NINETY-TWO
DOLLARS AND SEVENTY-FOUR CENTS($70,092.74);PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS,in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a
municipality,liens and forfeiture funds may be expended if accompanied by written certification that
the request complies with the provisions of the aforementioned subsections; and
WHEREAS, the Chief of Police has submitted a request for electrical work at two (2)
automatic license plate reader locations and remodeling of the Police Department kitchen for
hurricane preparedness supplies, in an amount not to exceed Seventy Thousand Ninety-Two Dollars
and Seventy-Four Cents ($70,092.74) in forfeiture (DOJ) funds in compliance with the
aforementioned legal requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification,
the Chief of Police is hereby authorized to spend up to Seventy Thousand Ninety-Two Dollars and
Seventy-Four Cents ($70,092.74) from the established Department of Justice (DOJ) federal
forfeitures account for electrical work at two (2) automatic license plate reader locations and
remodeling of the Police Department kitchen for hurricane preparedness supplies.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

Ratify the approval to expend partial Department of
Justice• (DOJ) Forfeiture Funds to complete electrical
RE: work at two automatic license plate reader sites and
hurricane preparedness kitchen with cooking supplies in
an amount not to exceed $70,092.74.

RECOMMENDATION:
It is recommended that the City Commission ratify the approval of the •
expenditure of partial Federal Forfeiture Funds (DOJ) previously
•
awarded to the Police Department as the result of investigative •
participation in forfeiture and seizure cases in an amount not to exceed •
$70,092.74.
REASONS:
Phase I of the Automatic License Plate Reader project required some
• unforeseen electrical work to complete the installation of two sites.
• Additionally. the modification of police department's kitchen and
i purchase.of supplies will allow the police department to provide food to
on duty police personnel during a natural disaster.
ADDITIONAL INFORMATION:
These funds are permissible by law to be spent for the purchases of
police equipment and other law enforcement activities as certified by
0 the Chief of Police.

The Sunny Isles Beach Police Department actively participates in DEA
and HI DTA (High Intensity Drug Trafficking Area) Initiative Groups that -
conduct numerous ongoing proactive investigations and now has a
need for the attached listed law enforcement equipment. • '

- ' - -One of the benefits of participating in and providing personnel into high
intensity narcotics investigations is the sharing of confiscated proceeds
for the enhancement of law enforcement.
