HomeMy WebLinkAboutReso 2019-3023 RESOLUTION NO. 2019- 3 0 23 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE RE-APPOINTMENT OF MEMBERS TO THE PUBLIC ARTS ADVISORY COMMITTEE CALENDAR YEARS 2020 AND 2021; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 74-8 of the Code provides that there shall be as many standing committees of the City Commission as the Mayor or City Commission deems necessary and that the City Commission may establish or terminate such Committees from time to time; and WHEREAS, on October 19, 2017 via Resolution No. 2017-2750, the City Commission created a new advisory committee entitled the "Public Arts Advisory Committee"; and WHEREAS, the Public Arts Advisory Committee ("Committee") is responsible for advising the City Commission on matters pertaining to the following: 1. Public Art Policy; 2. Selection of Locations for Public Arts Projects; 3. Providing Recommendations to the City Commission for Public and Private Art Projects; and 4. Tasks relating to the purpose of the Committee as determined by the City Commission or City Manager. WHEREAS, the Committee shall be composed of five (5) members who shall be appointed for two-year terms and_which may be renewed by the City Commission as often as desirable; and WHEREAS, the Chairperson and Vice Chairperson shall be selected by majority vote of the members of the Committee; and WHEREAS, Committee members shall be governed by the Rules of Procedure that govern the City Commission, the Florida Sunshine and Public Records Laws, and the terms of this Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Selection of Chair and Vice-Chair and Responsibilities of Public Arts Advisory Committee. The Chairperson and Vice Chairperson shall be selected by a majority vote of the members of the Committee. Additionally, a member of the Committee forfeits his or her right to serve on the Committee if such member fails to comply with the requirements of the City Code, R2019 Paac Re Appointments 2020-2021 Page 1 of 3 County Code and state law for serving on the Committee. The City Manager or designee shall create an application process for the selection of Committee members. The City Commission shall appoint applicants from the application process created by the City Manager or designee. Additionally: (a) Should any appointee resign during the term of the Committee, the Commission, by majority vote, shall select another appointee. (b) Members shall be appointed to serve for a two-year (2) term, but that term may be renewed as often as desirable. (c) Attendance Policy: The City's attendance policy for members of boards and committees provide that, if a member fails to attend three (3) duly noticed meetings of such groups without being excused for good cause, the member may be removed from his or her seat automatically. A board member or committee member may not be removed from his oril her seat unless the City Clerk certifies that the member has failed to attend three (3) duly noticed meetings. Committee duly noticed meetings of the board and committees include regular scheduled meetings and any special meetings. The' City Commission finds that personal illness, family emergencies, military l absences, family weddings, family graduation exercises, and bona fide business and vacation trips constitute good cause for nonattendance at a duly noticed meeting. Section 3. Re-Appointment of Committee Members.: The City Commission hereby approves the following re-appointments to the Public Arts Advisory Committee for calendar years 2020 and 2021: Name Title Jesse Cukierkorn !Member Diane Drabkin Member Fabio de Oliveira Member Javier Rabinovich Member Patricia Finchelman i Member Dr. Carla Hozebin iAlternate Section 4. Annual Reporting Requirements. The Committee shall provide the City Commission with a report regarding the activities of the Committee, as deemed necessary or appropriate by the City Commission, from time to time. Section 5. Rules of Procedure. The Committee shall be governed by the Rules of Procedure that govern the City Commission, and subject to Florida's Sunshine and Public Records Law and Financial Disclosure requirements. Section 6.
