A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF
POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME
CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION
932.7055,F.S.,TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE
DEPARTMENT OF JUSTICE (DOJ) AND LAW ENFORCEMENT
TRUST FUND (LETF) FOR COSTS ASSOCIATED WITH THE
ACQUISITION OF LAW ENFORCEMENT ACCREDITATION AND
MISCELLANEOUS COMMUNITY POLICING ITEMS AND
CHARITABLE CONTRIBUTIONS,IN AN AMOUNT NOT TO EXCEED
SIXTY-TWO THOUSAND DOLLARS($62,000.00);PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS, in accordance with Florida Statutes §932.7055(5)(c)(3) specifically, a law
enforcement agency that acquires at least$15,000.00 pursuant to the Florida Contraband Forfeiture
Actwith a fiscal year must expend or donate no less than 25% of such proceeds for the support or
operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe
neighborhood, school resource officer programs or for other law enforcement purposes; and
WHEREAS,in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a
municipality,liens and forfeiture funds may be expended if accompanied by written certification that
the request complies with the provisions of the aforementioned subsections; and
WHEREAS, the Chief of Police has submitted a request for costs associated with the
acquisition of law enforcement accreditation and miscellaneous community policing items and
charitable contributions, in an amount not to exceed Sixty-Two Thousand Dollars ($62,000.00) in
forfeiture (DOJ and LETF) funds in compliance with the aforementioned legal requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification,
the Chief of Police is hereby authorized to spend up to Sixty-Two Thousand Dollars ($62,000.00)
from the established Department of Justice(DOJ)federal forfeitures account and Law Enforcement
Trust Fund (LETF) for ongoing training, tactical equipment, and charitable contributions.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

MEMORANDUM

Approval to expend partial forfeiture funds on deposit
RE: from the Department of Justice (DOJ) and Local Law
Enforcement Trust Fund (LLETF)in amount not to
exceed $62,000.00.

RECOMMENDATION:
It is recommended that the City Commission approve the expenditure
of partial Forfeiture Funds (DOJ/LLETF) previously awarded to the
Police Department as the result of investigative participation in
forfeiture and seizure cases.
REASONS:
The use of these funds will allow us to fund the startup costs
associated with the pursuit of Law Enforcement Accreditation and
support law enforcement charities and activities. These funds are
permissible by law to be spent for the support of law enforcement
operations to include agency accreditation and other law enforcement
charities / activities. It is requested that we be permitted to utilize up to
$62,000.00 of said funds on deposit for such purpose.
ADDITIONAL INFORMATION:
One of the benefits of participating in and providing personnel into high
intensity narcotics investigations is the sharing of confiscated proceeds
for the enhancement of law enforcement. All of the attached items are
authorized expenditures and are designed towards charitable and crime

prevention programs, enhancement of law enforcement equipment as
well as legal costs associated with the asset forfeiture proceSs. - -
