HomeMy WebLinkAboutReso 2020-3106RESOLUTION NO. 2020 - _3" A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE EXPENDITURE OF BUDGETED FUNDS WITH ENVIRO-MASTER OF SOUTH FLORIDA FOR DISINFECTING SERVICES, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED TEN THOUSAND DOLLARS ($110,000.00); AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 9, 2020, Florida State Governor Ron DeSantis declared a State of Emergency for all of Florida due to COVID-19; and WHEREAS, on March 11, 2020, Miami -Dade County Mayor Carlos A. Gimenez declared a State of Emergency for Miami -Dade County due to COVID-19; and WHEREAS, on March 11, 2020, the World Health Organization ("WHO") declared the COVID-19 outbreak ("COVID-19") a pandemic; and WHEREAS, on March 12, 2020, and in accordance with Chapter 29 of the City of Sunny Isles Beach Code, the City Manager declared a local emergency due to COVID-19; and WHEREAS, the City of Sunny Isles Beach, and its facilities and assets, are threatened by COVID-19 because of the apparent ability of the virus to spread rapidly among humans; and WHEREAS, due to its highly infectious and lethal nature, COVID-19 constitutes a clear and present threat to the health, safety, and welfare of the employees and visitors of the City; and WHEREAS, the City was in need of a contractor to provide disinfecting services of its facilities and assets, including vehicles, shuttle buses, and bus shelters ("Services"); and WHEREAS, in March 2020 the City Manager authorized the expenditure of funds with Enviro-Master of South Florida ("Contractor") to provide the Services; and WHEREAS, pursuant to Section 62-13 (D) of the City's Code, these Services are exempt from the bidding requirements set forth in Chapter 62; and WHEREAS, the City now wishes to ratify the expenditure of budgeted funds, in an amount not to exceed One Hundred Ten Thousand Dollars ($110,000.00), with Enviro-Master of South Florida for disinfection services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Ratification Expenditure of Budgeted Funds. The City Commission hereby ratifies the expenditure of budgeted funds, in an amount not to exceed One Hundred Ten Thousand Dollars ($110,000.00), with Enviro-Master of South Florida for disinfection services. Russo, City Manager Sylvia Flores, Director of Cultural & Community FROM: Services DATE: 9/17/2020 RE: Ratifying Expenditures with Enviro-Master South Florida RECOMMENDATION: This item is presented for your consideration REASONS: In March 2020, Governor DeSantis declared a public health emergency due to the COVID-19 pandemic. At that time, the City also declared a state of emergency, as a result of the COVID-19 pandemic, and began looking into ways to ensure the safety and well-being of our employees and visitors to our facilities. We began working with Enviro-Master of South Florida, to perform weekly disinfection of City facilities and assets, including vehicles, shuttle buses, and bus shelters. The product used, Vital Oxide, has been approved by the EPA for use against SARS-CoV-2, the coronavirus that causes COVID-19. We began utilizing the service in March, and continued use of this service weekly, until Friday, September 3rd. We now have purchased the materials to be able to continue to this work in-house. This resolution is to ratify the expenditures with this company during that time, under the declared state of emergency, for an amount not to exceed $110,000. ADDITIONAL INFORMATION: Enviro-Master performed these services at Four Cents ($0.04) per square foot. While comparing pricing with other companies providing similar service, this was the lowest price we found. Under the current declared state of emergency, the City can utilize the emergency exemption to the competitive bidding requirements provided for in the code, 62-13(D): Purchases arising out of or because of emergencies which shall be defined as a situation, occurrence or matter necessitating immediate or quick action and not permitting adequate time to utilize the competitive bidding process.
