HomeMy WebLinkAboutReso 2020-3118RESOLUTION NO. 2020 - 311 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FOR THE PURCHASE OF EIGHT (8) SOLAR POWERED TRAFFIC SIGNS AND FIELD FORCE EQUIPMENT, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FIFTY-FIVE THOUSAND DOLLARS ($155,000.00); PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City and its Police Department are authorized to expend forfeiture funds from the established Department of Justice ("DOJ") federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, the Chief of Police has submitted a request for the purchase of eight (8) solar powered traffic signs and field force equipment, in an amount not to exceed One Hundred Fifty -Five Thousand Dollars ($155,000.00) in forfeiture DOJ funds in compliance with the aforementioned legal requirements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to One Hundred Fifty -Five Thousand Dollars ($155,000.00) from the established Department of Justice federal forfeitures account for the purchase of eight (8) solar powered traffic signs and field force equipment. Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 15t day of c ber 2020. George H. Russo, City Manager FROM: Dwight P. Snyder, Chief of Police DATE: 10/15/2020 Approval to expend partial forfeiture funds on deposit RE: from the Department of Justice (DOJ) in amount not to exceed $155,000.00. RECOMMENDATION: It is recommended that the City Commission approve the expenditure of partial Forfeiture Funds (DOJ) previously awarded to the Police Department as the result of investigative participation in forfeiture and seizure cases. REASONS: The use of these funds will allow us to provide complete field force equipment to every sworn police officer. This will ensure that personnel are equipped with the items necessary to respond to instances when crowd control is needed. Additionally these funds will allow us to purchase eight (8) solar powered fixed traffic speed signs. These signs will be placed in areas deemed necessary for a deterrent for speed violators. It is requested that we be permitted to utilize up to $155,000.00 of said funds on deposit for such purpose. ADDITIONAL INFORMATION: One of the benefits of participating in and providing personnel into high intensity narcotics investigations is the sharing of confiscated proceeds for the enhancement of law enforcement. All of the attached items are authorized expenditures and are designed towards charitable and crime prevention programs, enhancement of law enforcement equipment as well as legal costs associated with the asset forfeiture process.
