A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, APPROVING A SEVENTH AMENDMENT TO
THE AGREEMENT WITH PERKINS+WILL ARCHITECTS, INC. FOR
ARCHITECTURAL DESIGN SERVICES FOR THE PEDESTRIAN
OVERPASS BRIDGE AT 18080 COLLINS AVENUE, IN AN AMOUNT
NOT TO EXCEED ONE HUNDRED NINETY-THREE THOUSAND
FORTY-FOUR DOLLARS ($193,044.00), ATTACHED HERETO AS
EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID
AMENDMENT; AUTHORIZING THE CITY MANAGER TO DO ALL
THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on April 30, 2015, the City issued Request for Qualifications No. 15-04-01
for Architectural Design Services for a New Facility at 18080 Collins Avenue, of which eight (8)
responses were received; and
WHEREAS, on September 17, 2017 via Resolution No. 2015-2459 the City Commission
ratified an agreement with Perkins+Will Architects, Inc. ("P+W") to provide Architectural Design
Services for the Government Annex Building at 18080 Collins Avenue ("Agreement"), in an
amount not to exceed $2,222,000.00; and
WHEREAS, on December 17, 2015 via Resolution No. 2015-2504, the City Commission
approved a First Amendment to the Agreement to include interior design and consultant design
fees for the 250 -seat Community Theater integrated within the design of the Government Annex
Building, in an amount not to exceed $229,300.00; and
WHEREAS, on April 19, 2018 via Resolution No. 2018-2812, the City Commission
approved a Second Amendment to the Agreement to include the design of a pedestrian overpass
bridge integrated within the design of the Government Annex Building, in an amount not to exceed
$370,000.00; and
WHEREAS, on October 17th, 2019 via Resolution No. 2019-3002, the City Commission
approved a Third Amendment to the Agreement to include coordination with the Florida
Department of Transportation ("FDOT") and other regulatory agencies having jurisdiction over
Collins Avenue relating to the pedestrian overpass bridge, in an amount not to exceed $50,000.00;
and
WHEREAS, on February 20, 2020 via Resolution No. 2020-3044, the City Commission
approved a Fourth Amendment to the Agreement to include coordination with FDOT civil
engineering and architecture, cost estimate and formatting relating to schematic designs, and wind
modeling, in an amount not to exceed $183,850.00, bringing the total contract amount not to
exceed $3,055,150.00; and
WHEREAS, on July 16th, 2020 via Resolution No. 2020-3083, the City Commission
approved a Fifth Amendment to the Agreement to provide structural analysis and supporting
documentation for Construction Sequence Engineering, as requested by FDOT, provide the precast
concrete attachment details as part of the construction documents, engage GFRC manufacture,
Building Blocks, for design assist to develop the basis of design for the precast panel attachment
details and performance specifications, and to provide design assist to further define the GFRC

design to optimize fabrication, constructability and cost efficiencies, as requested by FDOT, in an
amount not to exceed $99,900.00, bringing the total contract amount not to exceed $3,155,050.00;
and
WHEREAS, on December 17th, 2020 via Resolution No. 2020-3147, the City Commission
approved a Sixth Amendment to the Agreement with for the development of a Maintenance of
Traffic plan, as required by FDOT, in an amount not to exceed $15,782.00, bringing the total
contract amount not to exceed $3,170,832.00; and
WHEREAS, city staff, along with P+W, met with FDOT and it was determined that
additional construction engineering services were required, including but not limited to: concrete
detailing, additional coordination related to traffic study, expanded construction sequence, facade
connection details in structural set, maintenance coordination and implementation, and
incorporation of added geotechnical information ("Additional Services"); and
WHEREAS, P+W has submitted quotes to perform the Additional Services, as required
by FDOT; and
WHEREAS, the City Commission now wishes to approve a Seventh Amendment to the
Agreement with Perkins+Will Architects, Inc. for the aforementioned Additional Services, in an
amount not to exceed One Hundred Ninety -Three Thousand Forty -Four Dollars ($193,044.00),
bringing the total contract amount not to exceed Three Million Three Hundred Sixty -Three
Thousand Eight Hundred Seventy -Six Dollars ($3,363,876.00), attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Seventh Amendment. The City Commission hereby approves a
Seventh Amendment to the Agreement with Perkins+Will Architects, Inc. for additional
construction engineering services were required, including but not limited to: concrete detailing,
additional coordination related to traffic study, expanded construction sequence, facade connection
details in structural set, maintenance coordination and implementation, and incorporation of added
geotechnical information, in an amount not to exceed One Hundred Ninety -Three Thousand Forty -
Four Dollars ($193,044.00), bringing the total contract amount not to exceed Three Million Three
Hundred Sixty -Three Thousand Eight Hundred Seventy -Six Dollars ($3,363,876.00), attached
hereto as Exhibit "A".
Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said
Amendment.
Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 4. Effective Date. This resolution shall become effective upon adoption.

RECOMMENDATION:
Staff is recommending the City Commission approve the attached
Resolution.
REASONS:
Staff is seeking approval of a Seventh Amendment to the Agreement
with Perkins & Will Architects, Inc. for additional architectural design
services for the pedestrian overpass bridge located at 18080 Collins
Avenue.
Perkins+Will, along with city staff, recently held meetings with the
Florida Department of Transportation (FDOT) and other regulatory
agencies having jurisdiction over Collins Avenue. In those meetings it
was determined that additional construction engineering services were
required, as requested by FDOT. Those requirements included:
concrete detailing, additional coordination related to traffic study,
expanded construction sequence, facade connection details in
structural set, maintenance coordination and implementation, and
incorporation of added geotechnical information.
Total amount for these additional services will not to exceed
$193,044.00.
FUNDING SOURCE:
Funds have been appropriated in account no. 300-5-5410-465005-
80005.

SEVENTH AMENDMENT TO THE AGREEMENT BETWEEN
THE CITY OF SUNNY ISLES BEACH AND
PERKINS & W.ILL ARCHITECTS, INC.
CONTRACT NO. C1415-087
This Seventh Amendment to the Agreement between the CITY OF SUNNY ISLES
BEACH. ("City") and PERKINS & WILL ARCHITECTS, INC. ("Architect"), executed this
Aday of t , 2021 is made a part of the original Agreement between the parties
dateAugust 21, 2015, as amended, Contract No. C1415-087 (the "Agreement"), and the City and
the Architect hereby agree to amend the Agreement as follows:
1. ADDITIONAL SERVICES. Pursuant to Section 1.3 of the Agreement, the City
hereby wishes to amend Article 3 of the Agreement ("Architect's Basic Services") to include the
services as more particularly described in composite Exhibit "A" ("Additional Services"), which
is attached hereto and incorporated herein by reference.
2. ADDITIONAL COMPENSATION. Article 2 of the Agreement is hereby
amended to include additional compensation for the Additional Services in an amount not to
exceed One Hundred Ninety -Three Thousand Forty -Four Dollars (S193,044.00), bringing the total
contract amount not to exceed Three Million Three Hundred Sixty -Three Thousand Eight Hundred
Seventy -Six Dollars ($3,363,876.00).
3. E -VERIFY. Florida Statute 448.095 directs all public employers, including
municipal governments, to verify the employment eligibility of all new public employees through
the U.S. Department of Homeland Security's E -Verify System, and further provides that a public
employer may not enter into a contract unless each party to the contract registers with and uses the
E -Verify system. Florida Statute 448.095 further provides that if a Consultant enters into a contract
with a subcontractor, the subcontractor must provide the Consultant with an affidavit stating that
the subcontractor does not employ, contract with, or subcontract with an unauthorized alien.
In accordance with Florida Statute 448.095, Consultant is required to verify employee eligibility
using the E -Verify system for all existing and new employees hired by Consultant during the
contract term. Further, Consultant must also require and maintain the statutorily required affidavit
of its subcontractors. It is the responsibility of Consultant to ensure compliance with E -Verify
requirements (as applicable). To enroll in E -Verify, employers should visit the E -Verify website
(https://www.e-verify.gov/employers/enrolling-in-e-verify) and follow the instructions. The
Consultant must retain the 1-9 Forms for inspection, and provide the attached E -Verify Affidavit,
attached hereto as Attachment "B".
4. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically
modified herein, all terms and conditions of the Agreement, as amended, shall remain in full force
and effect.
5. CONFLICTING PROVISIONS. The terms, requirements, and provisions
contained in this Seventh Amendment shall prevail and be given superior effect and priority over
any conflicting or inconsistent term, statement, requirement, or provision contained in any other
document or attachment, including but not limited to the Agreement, Exhibit "A" and Exhibit "B"
IN WITNESS WHEREOF, the parties have executed this Seventh Amendment to the
Agreement as of the date referenced above.

ASR DESCRIPTION Expanded Project Requirements Related to FDOT
ASR BACKGROUND & SCOPE
Based on preliminary feedback from the peer review engineer related to FDOT expectations, Thornton Tomasetti,
Inc. (TT) is pleased to submit this Additional Service Request (ASR) to provide expanded Structural Engineering
Services for Sunny Isles Beach Pedestrian Bridge (the Project). Due to the continued expansion of structural scope
based on FDOT requirements, we propose to complete the additional scope on a time and materials basis, We
understand the scope of services to include:
Concrete detailing
Per the FDOT SDM and the interpretation of the peer review engineer, the level of detailing for concrete elements
required for this project is well beyond the standard to which TT is accustomed to complying for buildings in the
area. Typically, we are able to Illustrate reinforcement requirements with typical details including standard bar size
and spacing, leaving it to the contractor and their subconsultants to interpret the drawings and produce shop
drwaings for review and approval.
According to comments from the peer review engineer, FDOT will require us to significantly expand upon our
details, including site specific details for each instance of an element, and information such as bar count and length
where we would typically only see that information in shop drawings.
The concrete elements in affected include the foundation, foundation walls at the elevator, and the base of the
lowest run of the stairs.
Additional coordination related to traffic study:
Per the FDOT SDM and the interpretation of the peer review engineer, the maintenance of traffic plan (MOT) must
be developed by the design team prior to selection of a contractor. The previous assumption of the civil engineer on
the project was that this would be developed in collaboration with the contractor. Developing it in advance requires
additional coordination with the sequencing drawings that TT has already been expanding as requested by FDOT
and the peer review engineer.
Expanded construction sequence:
The construction sequence shown in TT's drawings needs to be further expanded to consider details of the
concrete pour topping slab pour. Some items to be included are concrete thicknesses at various locations along the
span to account for anticipated deflection, the sequence of the concrete pour itself, and control joint locations. The
expanded construction sequence also requires coordination with the MOT as described. above.

Facade connection details in structural set:
The peer review team and FDOT are requiring a level of facade detailing that is beyond what the design team
anticipated at this stage of design. The facade consultant has provided conceptual details for connection, but TT
understands that those details need to be further developed for the 90% set, and TT will need to incorporate
additional coordination with and references to that desing in the structural drawing set.
Maintenance meetinci coordination and incor oration:
The design team had a meeting with the FDOT maintenance team, resulting in structural changes that need to be
incorporated into the structural drawings. Among these are an increase in depth of the box girder due to the
removal of cladding below the box girder and additional coordination with Perkins + Will regarding access to certain
structural elements.
Incorporation of additional geotechnical information:
Per FDOT SDG and feedback from the peer review engineer, certain information from the geotechnical report has
been incorporated Into the structural drawing set. Additional sheets for boring details were added, and
environmental classification needs to be coordinated with the geotechnical engineer and Included in the drawing
set.

AMENDMENT NUMBER 04 TO THE AGREEMENT BETWEEN THE CLIENT AND
KIMLEY-HORN AND ASSOCIATES, INC.
AMENDMENT NUMBER 04 DATED December 21, 2020, to the Agreement between Perkins & Will
Architects, Inc., the ("Client") and Kimley-Horn and Associates, Inc., ("Consultant") dated November
1, 2017 ("the Agreement") concerning "Sunny Isles Beach Government Center Annex" (the "Project").
The Consultant has entered into the Agreement with Client for the furnishing of professional services,
and the parties now desire to amend the Agreement.
Therefore, it is mutually agreed that the Agreement is amended to include Additional Services to be
performed by Consultant and provisions for additional compensation by the Client to the Consultant.

PROJECT UNDERSTANDING
This additional scope of services is for the development of civil engineering documents related to the
construction of a new pedestrian bridge within the Collins Avenue right of way and directly adjacent to
the City of Sunny Isles Beach Government Center.
SCOPE OF SERVICES
Consultant will perform the following Additional Services:
TASK 1 — 90% CONTRACT DOCUMENTS SUBMITTAL PACKAGE (COLLINS AVENUE)
During this task, Kimley-Horn responded to and addressed FDOT's comments on the civil
engineering 60% Contract Documents submittal package. Once the FDOT/Agency comments were
addressed, the 90% Contract Documents were submitted to the Client for inclusion in the Client's
overall 90% CD submittal package that was submitted by the Client to FDOT.
This task includes attendance to one (1) coordination meeting/tail with the Client/FDOT/Agency
reviewers as well as comment responses for one round of reasonable comments to the current
design without major design changes. Both additional meetings with reviewers and new, additional
comments, after the first review, and deviating from the original, intended design, will be addressed
as an additional service with written authorization from the Client, The 90% civil engineering contract
documents were submitted to the Client as an electronic PDF file.
TASK 2 — FINAL CONTRACT DOCUMENTS SUBMITTAL PACKAGE (COLLINS AVENUE)
During this task, Kimley-Horn will respond to and address FDOT/Agency review comments on the
civil engineering 90% Contract Documents submittal package. Once FDOT's comments are
addressed, the Final Contract Documents will be submitted to the Client for inclusion in the Client's
overall Final CD submittal package to be submitted by the Client to FDOT.
This task includes attendance to one (1) coordination meeting with the Client/FDOT/Agency
reviewers as well as comment responses for one round of reasonable comments to the current
design without major design changes. Both additional meetings with reviewers and new, additional
comments will be addressed as an additional service with written authorization from the Client. The
final civil engineering contract documents will be submitted to the Client as an electronic PDF file.
TASK 3 — EAST LANDING ON-SITE CIVIL ENGINEERING DOCUMENTS
The proposed pedestrian bridge will require harmonization of the bridge landing with the existing beach
access walkway and the private drive of the east property located at 18001 Collins Avenue, Sunny Isles
Beach, FL 33160. Additionally, isolated stormwater drainage system will also be required serve the
pedestrian bridge. This task includes the preparation of the stormwater management calculations and
report. This task is limited to the to the revisions of the plans listed below and located within the east
property along the east side of Collins Avenue. Design and relocation of existing drainage system
affected by the proposed bridge landing are not part of this scope of services. During this task, Kimley-

Horn will revise the following previously prepared government center on-site civil engineering contract
documents to address the inclusion of the pedestrian bridge.

TASK 4 — SIB GOVERNMENT CENTER ON-SITE REVISED CIVIL ENGINEERING DOCUMENTS
The proposed pedestrian bridge will require harmonization of the bridge landing with the existing
government center hardscape and the adjacent car rental parking lot. Additionally, relocation of the
existing water and fire services and localized drainage will also be required due to the location of the
pedestrian bridge. This task includes the preparation of the stormwater management calculations and
report. This task is limited to the to the revisions of the plans listed below and located within the SIB
Government Center site along the west side of Collins Avenue. During this task, Kimley-Horn will revise
the following previously prepared government center on-site civil engineering contract documents to
address the inclusion of the pedestrian bridge.

This task Includes comment responses for one (1) round of reasonable comments to the current

SCHEDULE
We will provide our services in an expeditious and orderly manner to meet the written schedule mutually
agreed to by the Client and the Consultant.
PROJECT RECOGNITION
The Client agrees to credit Kimley-Horn and Associates, Inc. for all Klmley-Horn generated images of
the project and to identify Kimley-Horn as the civil engineer for said Project in all communications,
advertisements and marketing materials.
PROJECT ASSUMPTIONS
Kimley-Hom assumes the following:
■ The Client will provide an updated site plan and survey in electronic AutoCAD format.
• The permitting process will be led by others.
• Civil engineering redesign of the existing drainage system within the private property east of the
pedestrian bridge will be provided by others.

• This scope of services does include design and/or permitting associated with the future government
center building and related site improvements outside of the pedestrian bridge.
ADDITIONAL SERVICES
The following tasks are not part of this scope of services, but may be provided as additional services,
if requested by the Client. These services may include, but are not limited to:
• Revisions to the plans due to substantial changes in project scope, budget, and/or concept.
• Services required by additional governmental regulations which might be put into effect after the
date of this agreement
■ Revisions to invoices or additional invoice backup coordination, such as work descriptions
■ Improvements outside the. originally agreed-upon project limits
■ Deliverables not specifically outlined in Tasks 1 through 6
• Meetings, presentations or coordination in addition to those described in the tasks above
• CSI format written specifications
■ Services not specifically included within "Scope of Services"
TO BE PROVIDED BY THE CLIENT
The following items are to be provided to Kimley-Horn by the Client:
• Site plan and Boundary, Topographic and Tree survey in electronic format (AutoCAD) of the project
site (Collins Avenue) and Sunny Isles Beach Government Center site.
• Ownership documentation required during permitting.
• Permit application fees, impact fees, and plan review fees

Kimley-Horn will perform the services described in Tasks 1 thru 4 of this Scope of Services for the lump
sum fees below plus expense basis. Lump sum fees will be invoiced monthly based upon the overall
percentage of services performed.

All permitting, application, and similar project fees will be paid directly by the Client.
Fees and expenses will be invoiced monthly based, as applicable, upon the percentage of services
completed or actual services performed, and expenses incurred as of the invoice date. Payment will
be due within 25 days of your receipt of the invoice.
FUTURE NOT IN SCOPE TASKS
Not included in the scope of services shown above are permitting tasks that can be provided as
additional services if requested by the Client. These tasks consist of:
TASK 5 — FOOT PERMITTING ASSISTANCE - $5,000
Kimley-Horn will assist the Client in preparation of the required FDOT/Agency permits associated with
improvements within the Collins Avenue right of way. At this time, we anticipate the following permits
will be required:
■ FOOT ROW Utility Permit
■ FOOT Drainage Permit
■ FOOT Access Permit
This task includes up to 25 -man hours for permitting assistance purposes. Additional man-hours, if
needed will be addressed as an additional service with written authorization from the Client.
Preparation of permit applications and submittals of the same as well as permit fees are not part of
this task.
TASK 6 — SIB GOVERNMENT CENTER ON-SITE PERMITTING ASSISTANCE - $8,000
Kimley-Horn will assist the Client in preparation of the required agency permits associated with the
inclusion of the bridge within the SIB Government Center site on the west side of Collins Avenue. At
this time, we anticipate the following permits will be required:
■ DRER Paving and Drainage Plan Review
■ City of Sunny Isles Breach Building Department
■ City of North Miami Beach Public Works Utility Dry Run- Water Service Relocates
This task includes up to 35 -man hours for permitting assistance purposes. Additional man-hours, if
needed will be addressed as an additional service with written authorization from the Client.
Kimley-Nom shall provide the required plans sets to the Client for processing to the applicable agencies.
Agency comments shall be provided to Kimley-Hom and once all agency comments are collected, Kimley-
Horn shall provide responses to these comments. Kimley-Horn shall respond to two (2) rounds of
comments.
Preparation of permit applications and submittals of the same as well as permit fees are not part of
this scope of services. All application, review, permit and impact fees are to be paid directly by the
City. Permits will be applied for in conformance with the guidelines for the listed entities. This task
assumes that the Client or Owner will contract the services of a permit expeditor to coordinate, submit
and transmit the required plans and permit documents as well as follow up with the applicable
permitting agencies.
Kimley-Horn does not guarantee the issuance of permits or approvals. If permits are issued for this project,
the conditions and expiration dates are the sole responsibility of the City. Kimley-Horn is not responsible
for extending time-limited entitlements or permits. Kimley-Horn may provide services related to permit time
extension requests and/or re-application of expired permits as an additional service.

ASR BACKGROUND & SCOPE
Items 1-3 below are a continuation of the work outlined in ASR01. Item 4 is additional effort required in response to
FOOT review comments on the 60% submission.
1. FOOT reviews:
-Meetings to explain bridge strategy to FOOT representatives
-FOOT approval process for firm and individuals
-FOOT review to confirm classification of bridge structure (4.2.2 vs. 4.2.3)
-Responding to FDOT's questions and concems related to the bridge structure
Multiple submissions to and reviews by FDOT, as opposed to a single permit review typical of the
building department.
2. Third party peer review:
-Meeting with multiple potential reviewers to outline design approach
-Responding to peer reviewer questions for clarification, etc
-Presenting detailed structural design to third party peer review team
-Reviewing and responding to peer review comments
-Incorporating peer review comments
3, Application of FOOT and AASHTO reouirements in lieu of FBC:
-Wind loading is per AASHTO as opposed to ASCE7-10, the referencend standard per FBC
-Load factors and load combinations are more extensive in AASHTO than FBG, resulting in more data
input for analysis models and more data to analyze through program output
-FOOT prohibits certain types of detailing or construction, requiring alternate approaches to
otherwise typical detailing
-FOOT strict maintenance requirements:
+Minimum clearance required inside of box girder, limiting geometric options
+Access panels through flanges and diaphragms.

-Expanding construction sequencing plans to include elements such as walkway deck, railing, and
GFRC panels
+Submit calculations showing sequential load considerations
+Provide loads for temporary towers
-Detailed review of helical frame connection to primary structure
+Consideration of shipping and galvanization vat size in segmentation of helical facade structure
+Investigate alternative framing solutions that allow a clear, intuitive separation in load path between
the facade and primary structure
-Coordinate GFRC connection details with facade consultant
+Detail connections with facade consultant
+Coordinate movement requirements at joints
+Allowance for removal of panels for inspection
-Exposure or accessibility of connections for inspection as required per approved maintenance plan

The deliverables associated with this ASR shall be drawing submissions in conformance with FDOT requirements.
Based on the estimated fee build-up below, TT will carry out this additional service on a Time and Materials basis
with a Not -to -Exceed (NTE) amount of $105,000. We will provide notice to the Client In the event that 90% of the
NTE amount is reached.

Florida Statute 448.095 directs all public employers, including municipal governments, to verify the
