A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, STRONGLY OPPOSING SENATE BILL 522
AND HOUSE BILL 219, WHICH SEEK TO PREEMPT THE
REGULATION OF SHORT-TERM RENTALS TO THE STATE;
DIRECTING THE CITY CLERK TO DISTRIBUTE COPIES OF THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Senator Manny Diaz Jr. has filed Senate Bill 522 ("SB 522"), and
Representative Jason Fischer introduced House Bill 219 ("HB 219") for consideration during the
2021 Florida Legislative Session seeking to preempt the regulation of short-term rentals to the
State; and
WHEREAS, the City has determined that its short-term rental ordinance protects the
life, health, and safety of its residents and visitors; and
WHEREAS, the City Commission believes that regulation of short-term rentals is
essential to protecting the rights of property owners in the City to be free of the deleterious and
adverse effects of unrestrained short-term rentals; and
WHEREAS, in January of 2021, City staff identified 1,351 units actively advertising for
short-term rentals within the City, thus, the ability to regulate short-term rentals is an issue of
critical importance to the City; and
WHEREAS, the City Commission believes that issues of this nature should be determined
locally, in accordance with the City's home rule authority; and
WHEREAS, the Mayor and City Commission declare their strong opposition to SB
522 and HB 219, and any substitute or similar Senate or House bill which preempts the
authority of local municipalities to protect their citizens and preserve the integrity of its
communities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Opposition to Senate Bill 522 and House Bill 219. The City Commission hereby
expresses its strong opposition to Senate Bill 522 and House Bill 219.
Section 2. Directions to the City Clerk. The City Clerk is hereby directed to distribute copies
of this Resolution to Senator Manny Diaz Jr., Representative Jason Fischer, Governor Ron
DeSantis, the Speaker of the Florida House of Representatives, the President of the Florida Senate,
the Florida League of Cities, and the Miami -Dade League of Cities.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

Opposing State Senate and House Bill Proposing
Preemption for Short Term Rentals
RECOMMENDATION:
This Resolution is submitted for your approval
REASONS:
The City of Sunny Isles Beach passed and adopted Ordinance No.
2018-522 on May 17, 2018. Pursuant to this ordinance, the City has
been able to quantify, identify, and regulate the rental activities of
multi -family units. This ordinance and the implementation has been a
challenge, however, it has provided crucial information and it has
giving us the tools to respond to our residents when dealing with short
term rental issues. Currently, the City has identified approximately
1,351 units actively advertising, which 700 are fully registered with the
City. Over the years, Code Compliance has engaged with 296 short
term rental cases and 61 are the queue to be investigated. Basically,
without the proper tools, such as this local ordinance, our local
government will be unable to respond to this quality of life matter.
