A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN
ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT
OF 1984 TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE
DEPARTMENT OF JUSTICE ("DOJ") FOR DESIGN, ENGINEERING, AND
PERMITTING SERVICES TO BE PERFORMED BY MAGELLAN
ADVISORS FOR THE BUILD -OUT OF THE FIBER OPTIC NETWORK,
AND FOR THE PURCHASE OF EIGHT (8) PRO LASER SPEED
DETECTORS, IN AN AMOUNT NOT TO EXCEED THIRTY-NINE
THOUSAND THREE HUNDRED THIRTY-NINE DOLLARS ($39,339.00);
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City
and its Police Department are authorized to expend forfeiture funds from the established Department
of Justice ("DOJ") federal forfeiture account, for the approved programs or purchases intended to
enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a
municipality, liens and forfeiture funds may be expended if accompanied by written certification that
the request complies with the provisions of the aforementioned subsections; and
WHEREAS, the Chief of Police has submitted a request for design, engineering, and
permitting services to be performed by Magellan Advisors for the build -out of the fiber optic
network, and for the purchase of eight (8) pro laser speed detectors, in an amount not to exceed
Thirty -Nine Thousand Three Hundred Thirty -Nine Dollars ($39,339.00) in forfeiture DOJ funds in
compliance with the aforementioned legal requirements.
NOW,'THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached
certification, the Chief of Police is hereby authorized to spend up to Thirty -Nine Thousand Three
Hundred Thirty -Nine Dollars ($39,339.00) from the established Department of Justice federal
forfeitures account for design, engineering, and permitting services to be performed by Magellan
Advisors for the build -out of the fiber optic network, and for the purchase of eight (8) pro laser speed
detectors.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

Approval to expend partial forfeiture funds on deposit
RE: from the Department of Justice (DOJ) in amount not to
exceed $39,339.00.

It is recommended that the City Commission approve the expenditure
of partial Forfeiture Funds (DOJ) previously awarded to the Police
Department as the result of investigative participation in forfeiture and
seizure cases.

The use of these funds will pay for half of the cost ($21,555.00)
associated with Magellan Advisors who will provide design,
engineering and permitting services for the build out of the fiber optic
network to eight different locations within the city. The police
department has numerous pieces of technology and a fiber optic
network would optimize this technology. It would also allow the police
department to expand several of the projects in the future which
support law enforcement activities.
Additionally the funds will be used to purchase eight (8) Pro Laser
speed detection devices for $17,784.00. These devices will be used to
enhance traffic enforcement throughout the city.
ADDITIONAL INFORMATION:
One of the benefits of participating in and providing personnel into
high intensity narcotics investigations is the sharing of confiscated
proceeds for the enhancement of law enforcement. All of the attached
items are authorized expenditures and are designed towards
charitable and crime prevention programs, enhancement of law
enforcement equipment as well as legal costs associated with the
asset forfeiture process.
