A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, GRANTING AN EASEMENT TO
FLORIDA POWER & LIGHT TO ALLOW FOR THE
UNDERGROUNDING OF OVERHEAD WIRES LOCATED ACROSS
THE PROPERTY ON COLLINS AVENUE AND 186Tn STREET,
ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY
MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach is converting the entire distribution overhead
electrical lines to underground in the City ("Project"); and
WHEREAS, there are existing overhead wires along the alley right-of-way that need to
be removed ("Services"); and
WHEREAS, Florida Power & Light ("FPL") requires an Easement in order to perform
the Services; and
WHEREAS, the City wishes to grant an easement to FPL to perform the Services,
attached hereto as Exhibit "A",
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Granting an Easement. The City Commission of the City of Sunny
Isles Beach hereby grants the Easement to Florida Power & Light to allow for the
undergrounding of the overhead wires located across the property on Collins Avenue and 186 h
Street, attached hereto as Exhibit "A".
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 3. Effective Date. This Resolution will become effective upon adoption by the City
Commission.

The undersigned, in consideration of the payment of $1.00 and other good MIAMI-DADE COUNTY, FLORIDA
and valuable consideration, the adequacy and receipt of which is hereby
acknowledged, grant and give to Florida Power&Light Company, its affiliates,
licensees, agents, successors, and assigns ("FPL"), a non-exclusive
easement forever for the construction, operation and maintenance of
underground electric utility facilities (including cables, conduits, appurtenant
equipment, and appurtenant above-ground equipment) to be installed from
time to time;with the right to reconstruct, improve,add to, enlarge,change the
voltage as well as the size of, and remove such facilities or any of them within

within the Easement Area and to operate the same for FPL's communications purposes in connection with electric service;the
right of ingress and egress to the Easement Area at all times; the right to clear the land and keep it cleared of all trees,
undergrowth and other obstructions within the Easement Area; the right to trim and cut and keep trimmed and cut all dead,
weak, leaning or dangerous trees or limbs outside of the Easement Area which might interfere with or fall upon the lines or
systems of communications or power transmission or distribution; and further grants, to the fullest extent the undersigned has
the power to grant, if at all, the rights hereinabove granted on the Easement Area, over, along, under and across the roads,
streets or highways adjoining or through said Easement Area.

RE: Granting an Easement to Florida Power & Light for Utility
Undergrounding at 186th Street and Collins Avenue
RECOMMENDATION:
Staff recommends approval of this Resolution.

REASONS:
FPL requires an easement for the placement of underground electrical lines across private or public
property where a Right -of -Way does not exist.
The above referenced property along with the adjacent Navarro Pharmacy are owned by the City.
The existing transformer servicing the pharmacy property was previously fed by the overhead lines
running in the alley ROW behind the pharmacy, these overhead lines will be removed. The conduit
installation across the subject lot are completed and will be energized once Phase 4 is completed. No
above ground equipment will be installed along this easement path.
FUNDING SOURCE:
Funds have been appropriated in account no. 300-5-5390-465000-80004.
