HomeMy WebLinkAboutReso 2021-3210RESOLUTION NO. 2021- 321 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ESTABLISHING A LATE FEE FOR FAILURE TO RENEW A SHORT-TERM RENTAL LICENSE OF MULTI -FAMILY DWELLING UNITS PRIOR TO THE EXPIRATION OF THE LICENSE; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 217-16 (A) of the Code of Ordinances ("Code") of the City of Sunny Isles Beach ("City") provides that Short -Term Vacation Rental Licenses are valid for no more than one year, and all licenses shall expire on September 30th of each year; and WHEREAS, Section 217-16 (B) of the Code provides that if an Owner or Responsible Party, as defined in Article II of Chapter 217 of the Code, files for a renewal of a Short -Term Vacation Rental License after its expiration, a late fee shall be assessed; and WHEREAS, Section 217-19 of the Code provides that all fees for the Short -Term Vacation License shall be adopted and modified by resolution of the City Commission; and WHEREAS, following a review of the administrative costs related to the processing of renewal applications for Short -Term Vacation Rental Licenses of multi -family dwelling units filed after their expiration, the City Manager is recommending that a late fee be established in the amount of Fifty Dollars ($50.00) to cover said administrative costs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Establishing Late Fee for Short -Term Vacation Rental License Renewals Filed after Expiration. The City Commission hereby approves the recommendation of the City Manager to establish a late fee in the amount of Fifty Dollars ($50.00) for Short -Term Vacation Rental License renewals of multi -family dwelling units filed after their expiration. Russo, City Manager FROM: Claudia Hasbun, Development Services Director DATE: July 15, 2021 RE: Establishing a Late Fee for Short Term Rental License Renewals RECOMMENDATION: Staff recommends approval of this Resolution. REASONS: During the Short Term Rental Licensing process, once an application is late for renewal, additional administrative steps must be taken to process such licenses. This resolution is to establish a $50.00 late fee to cover those additional steps, such additional reviews and notifications. ATTACHMENTS: Resolution Item Number: 10.6
