HomeMy WebLinkAboutReso 2021-3212RESOLUTION NO.2021 - IZ4 Z A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE REQUEST SUBMITTED BY 18401 DEVELOPERS, LLC. FOR A TEMPORARY SALES CENTER STRUCTURE LOCATED AT 18325 COLLINS AVE FOR THE PROJECT KNOWN AS THE BENTLEY RESIDENCES, SUBJECT TO CERTAIN CONDITIONS; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 265-14(B)(1)(d) of the Code of Ordinances of the City of Sunny Isles Beach ("City"), temporary sales centers established for the express purpose of marketing a real estate development projects require a temporary use or structure permit issued by the City; and WHEREAS, on or about June 16, 2021, 18401 Developers, LLC, the ("Applicant") submitted an application to the City requesting a temporary off -site sales center at 18325 Collins Avenue ("Property") for the project known as the Bentley Residences; and WHEREAS, pursuant to Resolution 2014-2354 adopted on December 18, 2014, the City Commission originally approved the Property as a temporary sales center for the Armani Casa project; and WHEREAS, pursuant to Resolution 2014-2354, Section 3.(4), the removal of the structure serving as a temporary sales center was to be removed no later than 30 days from the issuance of the temporary certificate of occupancy of the Armani Casa project; and WHEREAS, the developer for the Armani Casa project requested an extension of time for the removal of the temporary sales center, which was granted, therefore, the structure remains on the Property; and WHEREAS, the Applicant now wishes to renovate and utilize the existing structure as a temporary off -site sales center for the Bentley Residences; and WHEREAS, the City Commission wishes to approve the Applicant's request to modify the temporary off -site sales center. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval. Pursuant to Sections 265-11 and 265-14 of the Code of Ordinances of the City of Sunny Isles Beach, the City Commission hereby approves the application submitted by the Applicant, subject to the conditions set forth herein. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Conditions. The Applicant is required to comply with the following conditions: @BCL@2002485F.docx Pagel of 3 (1) The project shall be developed substantially in accordance with the plans submitted for temporary sales center approval. Plans created by The Sieger Suarez Architects, LLC stamped received June 16, 2021. Upon the submittal of an application for building permit, the plans submitted shall meet with the approval of the City Manager or his/her designee. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations. If the submitted plans result in a change that would not be considered minor, the Applicant shall be required to obtain approval of the City Commission. (2) That the Applicant has submitted site plan application for the project pursuant application PZ2021-06. In the event that the Applicant fails to obtain site plan approval for application PZ2021-06 within six (6) months of the adoption of this Resolution, the approval for the temporary sales center shall be deemed null and void. (3) A bond shall be posted by the applicant for the amount $20,000 that would be necessary if the City were placed in the position of having to remove said temporary sales center or trailer. (4) Removal of the sales center must comply with all City and County requirements. Removal shall occur no later than 30 days after Certificate of Occupancy is obtained for the Bentley Residences project, unless a site plan approval for a different project is approved for the subject property. (5) The Applicant shall comply with all conditions and permit requirements of the Department of Permitting, Environment and Regulatory Affairs (PERA), the Miami -Dade County Fire Department (MDFD), Water and Sewer Department, Department of Environmental Protection (DEP), Florida Department of Transportation (FDOT). (6) If the Applicant does not obtain a building permit for the temporary sales center within three (3) months of approval of the request to construct the off -site sales center, the approval shall be deemed null and void. Parking requirement: Staff Analysis: The Applicant is requesting approval to continue the use of a temporary sales center located at 18325 Collins Avenue. The proposal includes a model unit of the project with 5,043 sq ft. The sales center will consist of offices and a unit model for the proposed Bentley Residences project. The Bentley Residences project has not been approved by City Commission. Therefore, this application shall be null and void if the Bentley Residences in not approved within the next six months. Staff has reviewed the temporary sales center site plan submitted by the Applicant. Staff does not have any objection to the proposed sales center provided that the conditions set forth below are satisfied. Please note that the Applicant intends to maintain the north wing of the Bluegrass Motel to be used as additional sales/construction office space. REASONS: The temporary sales center located at 18325 Collins Avenue has been adapted and used as a sales center for previous projects. The Applicant, 18401 Developers, LLC. is requesting to continuing the us( of the existing sales center structure with certain modifications. This request pursuant to application No. PZ2021-10 is related to the pending site plan application No. PZ2021-06 known as the Bentle, project.
